What these words mean2
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

The inspectors’ words, 370 words
“Based on interview and record review, the Agency failed to update the Plan of Care to include drugs and treatments necessary to meet the needs of the patient in that 1 of 14 (Patient #11) patients Plan of Care/Medication List did not include medications Patient #11 was receiving for symptom management. There was no evidence the Plan of Care and Medication Profile had been updated to reflect the ABH cream and Fentanyl Patch. During an interview conducted with the DON on 10/28/2024 at 12:38 PM, Surveyor reviewed the Plan of Care and Medication Profile for Patient #11 for the certification period of 04/25/2024 to 05/21/2024 with the DON. The inspectors’ words, 427 words
“Based on record review and interview, the Agency failed to ensure the interdisciplinary group maintained responsibility for coordinating and supervising the care and services provided for 1 of 14 (Patient #11) patients whose records were reviewed, in that the Agency failed to ensure there was coordination of care with the Physician when Patient #11s Family Member contacted the Agency to report unmanaged pain and anxiety. This failure had the potential that Patient #11s needs were not met and could result in additional pain and distress for Patient #11 due to the Agencys lack of intervention for symptom management. Findings included: Review of the Agencys policy and procedure manual revealed a policy entitled, “;Coordination of Services,” dated 01/31/2015 which read in part, “;A. The interdisciplinary group will: 1. Ensure the effective exchange and ongoing sharing of information: a. Review of the Agencys On-Call Log, not dated, revealed the Agency received a call from the Family Member of Patient #11 on 05/19/2024 at 10:41 AM. The On-Call Log read in part, “;[Patient #11]...in a lot of pain and restless...” Review of the Agencys On-Call Log, not dated, revealed the Agency received an additional call from the Family Member of Patient #11 on 05/19/2024 at 3:46 PM. The On-Call Log read in part, “;CALLING AGAIN....[Patient #11]...in a lot of pain and restless.” Review of the clinical record of Patient #11 failed to include a communication note regarding the phone calls received on behalf of Patient #11 regarding unmanaged symptoms on 05/19/2024 and documentation of coordination of care with the Physician regarding Patient #11s unmanaged pain and anxiety. An interview was conducted with the DON on 10/31/2024 at 1:10 PM. The on-call log was reviewed with the DON. The DON stated LVN #3 spoke with the Family Member of Patient #11 via telephone after the phone calls were received. The DON stated Patient #11s Family Members “;Refused visits a lot.” The DON acknowledged there was no documentation regarding the phone calls received on 05/19/2024, on behalf of Patient #11, indicating the Physician was notified of Patient #11’s unmanaged pain and anxiety.”
