What these words mean2
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

The inspectors’ words, 339 words
“Based on record review and interview, the agency failed to complete a Provider Investigation Report after reporting an allegation of exploitation of a client by an agency employee to HHSC, for 1 of 19 patients (Patient #16) for which records were reviewed. This failure resulted in HHSC not receiving the required documents related to the incident and has the potential to place the clients at risk of on-going exploitation when not investigated timely. Findings Included:Review of the Consumer Rights and Services Incident Investigation Report Intake #523186 dated 08/07/2024 revealed the agency became aware of an allegation of exploitation on 08/06/2024 and filed the self-report within the required timeframe. Complainant #1 notified the agency that sometime between February and April 2024 agency Chaplain #1 accepted a monetary gift of $1,000 from Patient #16. Complainant #1 reported she asked Chaplain #1 about the money and Chaplain #1 told her he told Patient #16 that he was about to start a new church group and the patient offered him the money, so he accepted it. Review of the clinical record for Patient #16 revealed a start of care date of 12/23/2022. Pt #16 was discharged on 08/02/2024 for an extended prognosis. An interview was conducted on 11/04/2025 at 2:25 PM with the A/SN regarding the self-reported incident #523186. The surveyor requested a copy of the agency Form 3613- Provider Investigation Report related to the intake. A/SN stated she did not complete a PIR. A/SN was asked why a PIR was not completed. A/SN stated she filed a report with DFPS and thought that was all that was needed. Review of a policy titled “Patient abuse, neglect & exploitation, S17”, Original Issue Date 01-01-2000, Reviewed 09-25-2024, Revised Date (blank) revealed “The Director of Operations or Vice President of Operations completes an investigator form. Submits completed Provider Investigation form to the HHS state office via mail or fax and must be received by HHS no later than the tenth day after reporting the act to HHS and the Department of Family and Protective Services.””
