What these words mean2
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Timeframe for completion of assessment (42 CFR 418.54(b))
The inspectors’ words, 188 words
“It is required that the hospice Interdisciplinary Group, in consultation with the individual’s attending physician (if any), completes an initial comprehensive assessment no later than five (5) calendar days after the election of hospice care, in accordance with CMS §418.24–the elements of the hospice care election statement. This standard was not met as evidenced by clinical record review and interview. In 1 of 14 (7%) clinical records reviewed, the agency did not ensure that the initial comprehensive assessment, to include the spiritual assessment, was completed no later than five (5) calendar days after the election of hospice care. Clinical Record 7: The patient elected the hospice benefit on 01/14/2025 and accepted Chaplain services on admission. On 01/27/2025, the Chaplain documented, “This writer just returned from vacation to find that the patient’s former chaplain had not yet completed the initial assessment. This Chaplain will do so ASAP, therefore.” The initial spiritual assessment was documented on 01/28/2025, which was outside the 5-day requirement. On 06/12/2025, during an interview and the joint record review, the Director of Clinical Services stated, “It shouldn’t have been missed, that Chaplain no longer works here.””
-
Level of activity (42 CFR 418.78(e))
The inspectors’ words, 262 words
“It is required that hospice volunteers provide day-to-day administrative or direct patient care services in an amount that, at a minimum, equals five percent (5%) of the total patient care hours of all paid hospice employees and contract staff. This standard was not met as evidenced by document review and interview. The agency did not ensure that volunteers provided day-to-day administrative or direct patient care services in an amount that, at a minimum, equaled five percent (5%) of the total patient care hours of all paid hospice employees and contract staff. A review of the agency’s volunteer cost savings report for the calendar year 2024 documented that the average volunteer hours equaled 3.13%. The documentation for January 2025 through May 2025 revealed that the hours averaged 0.36%. During an interview on 06/10/2025, the Volunteer Coordinator (VC) reported that the agency had struggled with volunteer recruitment and utilization. The VC said that in the two months that they had been in the role, they had increased recruitment activities and had three (3) individuals interested in starting, which would increase the total number of volunteers to five. The Administrator confirmed the struggle with recruiting volunteers and said that they are confident that with the new Volunteer Coordinator in place, they will have better results. A review of the volunteer cost savings report revealed that the agency did not ensure the volunteers provided day-to-day administrative or direct patient care services in an amount that, at a minimum, equaled five percent (5%) of the total patient care hours of all paid hospice employees and contract staff.”

- CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
- Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
