What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Intent to Place on Warning of ProbationDelaware has given notice: Intent to Place on Warning of Probation.
Apr 1, 2026OCCL Standards Complaint: SubstantiatedOn March 17, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding release of children and unqualified staff being alone with children. An investigation was conducted on March 19, 2026. This complaint is substantiated for unqualified staff being alone with children because according to attendance records recently obtained for March 2, 2026 March 11, 2026, an unqualified staff person was alone with the infants on four of the six days reviewed. There is no evidence to substantiate the allegation of improper release of children because staff interviewed stated guardian permission was obtained prior to the children leaving the center. Calls logs and text messages reviewed support this. However, removing children from the center s care, even with parent/guardian permission, should not be a way the center maintains compliance with required ratios. Other concerns noted were safe sleep violations and restricted space for free movement in the one-year-old classroom.
Apr 1, 2026OCCL Standards Complaint: SubstantiatedOn March 3, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding improper staff-to-child ratio, unqualified staff alone with children, staff files, not following the policy in the parent handbook on dietary restrictions, not providing truthful information, lack of supervision, safe sleep practices, infant feeding, not cleaning bottles in the approved food preparation space, not meeting the needs of the children, accident/injury procedures, confidentiality, pets, not labeling children s bottles, cots, or cubbies, Administration of Medication, sanitation, and health exclusions. An investigation began on March 11, 2026, and concluded on March 24, 2026. This complaint is substantiated for improper staff-to-child ratio because according to attendance records reviewed, classrooms were over ratio on multiple days. One day, the Lotus Blossom classroom was over ratio with as many as 19 children present, ages ranging from infant to five-years-old, with two staff. This complaint is substantiated for unqualified staff being alone with children because according to attendance reviewed, an unqualified staff person was alone with the infants on four of the six days reviewed. This complaint is substantiated for staff files, because one staff file was reviewed and found to be missing multiple documents. This complaint is substantiated for lack of safe sleep practices because an infant was observed asleep in a crib with a binky strap still attached to the binky and a blanket hanging over the side rail of the crib. This complaint is substantiated for infant feeding because bottles were observed not labeled with the child s name. Staff interviewed stated infants will be placed in boppy pillows or swings with their bottle propped for feeding. Staff also stated an infant who holds their own bottle will be placed in a boppy or swing, not a required highchair with T-strap. This complaint is substantiated for not cleaning bottles in an approved space because staff interviewed stated they wash all dishes and bottles in handwashing sinks. This complaint is substantiated for pets, because staff interviewed stated a dog was brought into the center, but families were not notified in advance, and the dog s vaccinations were not on site. This complaint is substantiated for not labeling required items, because during the walk-through, it was noted bottles were not labeled with the child s name and food containers were observed not being labeled with the child s name, contents, or expiration date. This complaint is substantiated for improper administration of medication because of the 11 medications reviewed, six did not have a corresponding Medication Administration Record (MAR). There is no evidence to substantiate the allegation the center did not follow their handbook s policy on dietary restrictions, because staff interviewed stated they documented it in the child file and did not serve the child the food, which coincides with their own policy. LS #1 verified this documentation. There is no evidence to substantiate the allegation the center does not provide truthful information because staff interviewed denied this. Meal count forms were also reviewed and absences were documented. There is no evidence to substantiate the allegation children are allowed to walk around the center and enter different classrooms, because staff interviewed denied this. There is no evidence to substantiate the allegation of children s needs are not being met in the infant classroom because staff interviewed denied this. There is no evidence to substantiate the allegation of accident/injury procedures not being followed because staff interviewed stated an infant did not fall onto the floor, and therefore, no injury occurred. There is no evidence to substantiate the allegation confidentiality was breached because staff interviewed stated the child who was injured told their parent/guardian the name of the child who hurt him/her. There is no evidence to substantiate the allegation of not following sanitation requirements because cleaning procedures are posted in each classroom and staff interviewed stated cleaning is being done appropriately. There is no evidence to substantiate the allegation health exclusions are not being followed because staff interviewed stated they send children home, as needed, and while they wait on pick-up, they are kept in the office away from other children. Other concerns noted were cords, outlets, and fans being accessible to children, a wall in need of repair, cleaners being stored with food in the kitchen, diapering procedures not being properly followed, staff being on site without a comprehensive background check and eligibility determination, a child not being signed out, children eating from food containers they had previously eaten from, cleaners and disposable gloves being accessible, infants being left in confining equipment for longer than 30 minutes, a thermometer not being available in a classroom s refrigerator, infants and toddlers being cared for with older children after the first 90 minutes of the center opening, and room capacities not being followed.
Jul 9, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn June 24, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding using alcohol while caring for children, staff not having a health appraisal indicating they are able to care for children, and staff not being respectful by not using non-threatening tones. An investigation was conducted on July 1, 2025. There is no evidence to substantiate this complaint because all staff interviewed stated they have never suspected a staff person in the center of consuming or being under the influence of alcohol while working. Staff #1 denied all allegations of drinking while working, further stating the doctor completing the health appraisal misrepresented the information he/she shared with them. While speaking with Staff #1, there was no physical evidence to prove he/she was consuming alcohol. Staff #1 spoke articulately, his/her eyes were clear, and there was no detectable odor of alcohol. Lastly, all staff interviewed stated they have never heard Administrator #1 use threatening language or tones while speaking on the phone or in person to others.
Aug 29, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn July 15, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding unsafe indoor space. An investigation was conducted on August 1, 2024. There is no evidence to substantiate this complaint because during a thorough walk-through of the center for a full compliance visit, Licensing Specialist #1 did not observe any furniture made of plywood and crates. Additionally, Owner #1 denied the allegation of using plywood and crates as a table for children.
Jun 20, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn June 3, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding fencing requirements. An investigation was conducted on June 3, 2024. There is no evidence to substantiate this complaint because although the large, rear gate in the fence was broken, there is a plan to have it repaired, and it was securely closed with cords rendering it inaccessible to children. Additionally, there is another gate and an exit into the center which can be accessed by the children. The fence height was previously approved by OCCL and has not changed.
Feb 23, 2024OCCL Standards Complaint: SubstantiatedThe Office of Child Care Licensing (OCCL) received a complaint on February 5, 2024, regarding improper staff-to-child ratio. An investigation was conducted on February 6, 2024. This complaint is substantiated for improper staff-to-child ratio because during the visit a staff without eligibility was alone with children, and according to attendance records, there were several days when staff were not signed into classrooms, but children were present.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
