What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Oct 12, 2026OCCL Standards Complaint: No Evidence to SubstantiateOCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On September 24, 2026, OCCL received a complaint regarding an allegation the program did not inspect the playground area for hazards before being used by the children. There is no evidence to substantiate this complaint for that allegation. The self-report received from Administrator #1 stated the playground was checked by Staff #1, and the bag may have blown into the playground after the check. Staff observed the child pick up the bag, immediately responded by taking the bag, contacting the administrator, ensuring the child had not contacted any substance, and calling 911 and the child s parent. The child was medically examined and discharged with no concerns.
Oct 7, 2026OCCL Standards Complaint: SubstantiatedOn September 8, 2026, OCCL received a complaint regarding failure to use appropriate behavior supports. This incident was previously self-reported to OCCL by Administrator #1 on August 27, 2026. An investigation began on August 27, 2026, and concluded on September 15, 2026. Based on the self-report, video evidence, and interviews, this complaint is substantiated for failure to use appropriate behavior supports. LS #1 viewed the video footage showing Staff #1 did not use appropriate behavior supports to gain Child #1 s attention while on the playground, resulting in a nail mark being left on Child #1. Staff #1 s employment was terminated by the facility. A concern noted was the center failed to provide a completed accident or injury report to the parent, guardian, or authorized release person on the day of the accident or injury or within one business day. Administrator #2 asked Staff #1 to write up an injury report. Staff #1 never wrote the report, so Administrator #1 wrote the report and provided it to Parent #1, who signed the report on September 2, 2026, for the incident on August 26, 2026.
Jul 29, 2026OCCL Standards Complaint: No Evidence to SubstantiateOn July 13, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of incorrect staff-to-child ratio and improper combining of ages. An investigation began on July 20, 2026. Based on an interview with the administrator, a review of attendance records, and interviews with staff members, there is no evidence to substantiate this complaint for incorrect staff-to-child ratio or improper combining of ages. Administrator #1 stated children ages three through five are grouped in the Lions classroom during morning drop-off, while children ages one and two are grouped in the Lambs classroom. LS #1 s review of attendance records confirmed these statements.
Oct 21, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn September 5, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding not providing injury reports, not following policies for termination of care, not handling parent complaints, and not using appropriate behavior supports. These concerns were self-reported to OCCL by Administrator #1 at a visit on September 8, 2025. An investigation began on September 8, 2025, and concluded on October 16, 2025. There is no evidence to substantiate this complaint for not providing injury reports, not following policies for termination of care, not handling parent complaints, or not using appropriate behavior supports. Prior to the complaint visit, Administrator #1 sent OCCL documentation regarding communication with Guardian #1, signed behavior reports, and strategies that were put in place to help the staff with classroom management, as well as a plan for Child #1. Documentation was signed by Guardian #1 including behavior reports and termination of care after the two biting incidents. Staff and administrator interviews stated there were no incidents of staff forcing, encouraging, or allowing children to fight, staff were not rude to children, and there was a procedure in place for children to use the bathroom when on the playground.
Sep 10, 2025OCCL Standards Complaint: No Evidence to Substantiate with ConcernOn July 11, 2025, the Office of Child Care Licensing received a complaint regarding failure to use positive behavior supports. An investigation began on July 17, 2025, and concluded on July 30, 2025. The facility conducted an internal investigation and terminated the employment of Staff #1 on July 15, 2025, prior to the OCCL initial onsite complaint visit. Based on a review of video footage, staff interviews, written statements, and internal investigation records, there is no evidence to substantiate this complaint for failure to use positive behavior supports. Additional concerns noted were although video recordings and staff statements document that Staff #1 did not make physical contact with Child #1, Staff #1 failed to be respectful and used a threatening action while interacting with Child #1. An additional concern noted was that Staff #1 was observed using a cell phone while caring for children.
Mar 18, 2025OCCL Standards Complaint: SubstantiatedThe Office of Child Care Licensing received a complaint on February 26, 2025, and additional information from the same Reporter on March 5, 2025, regarding allegations of failing to provide the required physical activity and outdoor play opportunities for children, incorrect staff-to-child ratios, not providing water to children as needed, and not following diapering procedures. An investigation was conducted on March 5, 2025. Based on the interviews, this complaint is substantiated for failing to provide the required physical activity and outdoor play opportunities for children. Two staff stated they have not gone outside since the end of last summer. Based on interviews and a review of attendance records, there is no evidence to substantiate this complaint for incorrect staff-to-child ratios, failing to provide water, or failing to follow diapering procedures. All documents reviewed showed classrooms maintained correct staff-to-child ratios. All staff interviewed stated water is available throughout the day in all classrooms. Classrooms were observed to have water available at the time of the visit. Documentation reviewed and staff interviews showed checking and changing of diapers is conducted as required.
Nov 14, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn October 11, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding cell phone use by staff and not meeting the needs of children. An investigation was conducted on October 17, 2024. There is no evidence to substantiate this complaint for staff using cell phones while caring for children, or not meeting the needs of children. After speaking with administration and observing classrooms, staff members were actively engaged with the children and were not using cell phones. The administrator stated staff sometimes need to use cell phones to access the ProCare application when iPads are not working.
Oct 31, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn October 11, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding sanitation issues. An investigation was conducted on October 17, 2024. There is no evidence to substantiate this complaint for sanitation issues. After observations and interviews were conducted, the classrooms were clean, and sanitizing procedures are compliant with DELACARE Regulations.
Feb 14, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn February 5, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding lack of supervision and not notifying OCCL of a child’s injury requiring medical attention. An investigation was conducted on February 9, 2024. Based on the results of this investigation there is no evidence to substantiate this complaint because the center administrator notified OCCL s intake worker on January 30, 2024, regarding Child #1 s accident/injury that occurred on January 29, 2024. Also, the center administrator stated she was not aware Child #1 was taken to the doctor for the second accident/injury because the child had not returned to care. There is no evidence to substantiate that children were not being properly supervised because the center administrator and Staff #1 both stated children were being supervised by two staff members at the time of the accident, but Child #1 was injured because he jumped off the steps.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
