What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Sep 22, 2025OCCL Standards Complaint: SubstantiatedOn August 25, 2025, OCCL received a complaint regarding concerns of lack of supervision. A visit was conducted on August 29, 2025, to investigate this complaint. This complaint is substantiated for lack of supervision because during the investigation, Administrator #1 confirmed Child #1, who is two years old, had gotten out of the playground for an unknown period of time, and Staff #1 was unaware until Child #1 was returned by Pedestrian #1. An additional concern noted was Child #1 s parents and OCCL were not notified of the incident as required. In addition, according to attendance records Staff #1 was responsible for nine two-year-old children from 9:16 am to 12:00 pm, resulting in the classroom being out of staff-to-child ratio.
Apr 1, 2025OCCL Standards Complaint: No Evidence to SubstantiateOCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On March 3, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of lack of supervision. An unannounced visit was conducted on March 6, 2025, to investigate this complaint. There is no evidence to substantiate this complaint because Staff #1, Administrator #1, and Staff #3 stated that school-age children do not share a bathroom with younger children, and all staff interviewed stated there is never a time those children would have been combined in the bathroom. Staff #2 noted when present in the classroom, they stand at the door of the bathroom when children are using it to supervise them. The two separate bathrooms were observed. As of the date of this report, there has not been an update on Child #1 s evaluation at the hospital, and Parent #1 has not contacted the facility nor has Child #1 returned to care.
Mar 19, 2025OCCL Standards Complaint: SubstantiatedOCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On February 21, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of classrooms not being within the required temperature range and the heat not working, the use of portable space heaters, improper sanitation of cleaning of classroom items, and mixing of age groups due to low staffing. An investigation was conducted on February 27, 2025. This complaint is substantiated for using a portable space heater in one of the classrooms. Owner #1 stated they purchased a space heater to help with the cooler temperatures in the morning in the infant classroom. The cord to the space heater was not accessible to the children. There is no evidence to substantiate this complaint for the heat not working, as all classrooms were within an acceptable temperature range upon arrival. There is no evidence to substantiate this complaint for improper sanitation of classrooms. All classrooms had bleach and water and soap and water, and both products were available and accessible for staff upon arrival. Staff #1 stated staff cleans items after each activity, cleans tables after meals and at the end of the night, rugs are vacuumed, and floors are swept and mopped at the end of the day. There was no evidence to substantiate this complaint for the inappropriate mixing of age groups because there were no infants observed in the older classrooms. While there were three-year-old children mixed with school-age children, this occurred during the first 90 minutes of the day. An additional concern noted during this visit was the observation of improper staff-to-child ratios during the visit as well as verification of improper staff-to-child ratios on attendance records. According to the attendance records collected at the visit on February 25, 2025, Staff #4 had more than six and up to 14 children ages one to two alone from 7:40 am until 8:25 am. At 8 :25 am, seven children were signed out from the classroom, still leaving Staff #4 out of ratio with nine children until 9:30 am. Two additional children were signed out at 9:30 am, leaving Staff #4 out of ratio with seven children ages one and older the remainder of the day. Staff #4 was signed out for a break from 12:23 pm to 12:53 pm with no staff coverage. Additionally, the combined classroom with children ages three to school-age was observed over exceeding staff-to-child ratio during this visit with 12 children and one staff member. An additional concern noted was inaccurate child attendance records due to children not being signed out on multiple days of attendance records viewed.
Dec 10, 2024OCCL Standards Complaint: No Evidence to SubstantiateOn November 1, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding concerns of a lack of respectful communication with parents/families. An investigation was conducted on November 20, 2024. There is no evidence to substantiate this complaint based on interviews with staff and Owner #1. Staff #1 and Administrator #1 confirmed Administrator #1 had no contact with Parent #1 and was not involved in an altercation that occurred between Staff #2, Parent #1, and Parent #3, which led to Parent #1pulling Child #1 from the facility. Staff interviewed stated Child #1 s care was not terminated from the facility, Child #1 s care was pulled by choice. Administrator #1 stated she had no altercation or conversation with Parent #1 and was not involved in their incident. Staff #1 and Owner #1 noted no concerns about Administrator #1 s interactions with staff and families.
Dec 1, 2023OCCL Standards Complaint: No Evidence to SubstantiateOn October 23, 2023, a complaint was called into the Child Abuse and Neglect Report Line and was not accepted for investigation by the Institutional Abuse Unit (IAU). The Office of Child Care Licensing (OCCL) received the complaint on October 26, 2023, and accepted it for concerns of lack of supervision. A visit was conducted on November 1, 2023. Based on the information received, there is no evidence to substantiate this complaint. Staff #3 mentioned she did not see a scratch mark on Child #1 s face on October 11, 2023. Ms. Tull, Staff #2, and other parent witnesses stated they did not see a scratch on Child #1 s face on October 11, 2023.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
