The product, in the report: Modern Masters Metal Effects Baroque Paint Reactive Metal 16oz plastic cylinder bottle with screw on cap 473 ml

Modern Masters is selling a defective product. My 16 oz bottle of paint exploded off a table in my garage hit the ceiling and damaged over $8,000 in claims , witnessed happening. We are a professional faux finish paint company with years of experience. We had noticed some of the bottles of “Modern Masters Metal Effects Paint” bottles sucking in but did not give much notice due to we have at least 30 bottles all tubbed and racked on shelves. When this happened we called Modern Masters (MM) and spoke to [REDACTED] in Tech support. She said yes this particular color of product had many returns and issues of bottles sucking in due to the gases building up in the bottles increasing pressure so the stopped manufacturing it 2-3 yrs ago. Now in a claim the story is changing to poor seller. This is a big problem since the product that supposedly has not been manufactured for 2-3 years is being sold today! The bottles have no warnings or expiration dates on package and they treated me like I was using my old old product (my fault) I told them I purchased the products Jan of 2011 and again in Sept 2011 as new. They immediately told me to dispose of all the baroque paint which I had 4 bottles 2 opened but were all sucked in. I took pictures and destroyed it. After this claim is now being denied I need to forward it up to you! Over the past 2 days I went to two paint stores and purchased the product all suck in bottles manufactured from 2004-2009 still on shelves. And Baroque heading into a law suit. The only way their general liability will pay me is if I surrender the exploded bottle to them even though the insurance adjuster came took pictures, I took pictures and lots of video and have a witness who saw it happen. My lawyer says It would be absurd for me to submit ALL Evidence to the company I am suing. I offered to have a third part lab look at it, I offered to send a sample or have them come to me and test it but I will not give it to them and have no evidence. They denied this. This Metal Effects is a reactive patina paint. It patinas over time and is full of metal particles like copper, iron and other hazards although they claim no required health warning required ASTM D4236 no labeling required... Not only is it obvious defective and dangerous the force it blew but a dent in my metal garage door! which was up at the time. This should be recalled and company sanctioned. Their are not serial numbers and the manufacture dates I have were labeled by the paint store and not MM. Vista Paint stated they have not recieved any recall only color is discountinued but can be sold.
