The product, in the report: SERWALL 3-Person Patio Glider Bench featuring a middle drop-down console table (foldable cup holder an [REDACTED]
I ordered 2 Serwall Bench gliders from Amazon. Received and assembled 1 of the gliders on August 3rd. Not only was the glider defective in that, it would not glide, but when my spouse and I sat down on the glider the middle pull down cup holder-table slammed down almost clipping my arm and causing harm. I quickly moved out of the way before it slammed all the way down to the seat. So therefore, I am reporting a severe, high-risk design flaw in the newly assembled SERWALL Patio Glider Bench. The unit features a heavy, integrated drop-down center table. A warning sticker affixed to the unit indicates that this table assembly weighs 22 pounds. The critical safety defect is that there is absolutely no mechanical latch, locking mechanism, strap, or adjustable tension screw provided to secure this 22-pound table when it is pushed up into the closed, upright position. It relies entirely on gravity-balance to stay up. Because there is no way to secure or tighten the table, the slightest motion or movement as someone sitting down on the bench, a minor bump, or the normal gliding motion or even a heavy wind would cause the 22-pound table to instantly and violently drop forward into the middle seating position. Description of Potential Injury: If a toddler, small child, or pet climbs onto the bench or stands near the center seating area when the table unexpectedly drops, the force of a 22-pound solid panel falling from head-height could easily cause catastrophic head trauma, concussions, facial fractures, or severe crushing and pinch injuries. The lack of a basic locking mechanism presents an immediate, unreasonable risk of injury, especially a child or small pet. I immediately reached out to Amazon Customer service. They had the Serwall company reach out to me through Amazon messaging center. I explicitly notified the Serwall via Amazon messaging center, about this 22-pound crushing hazard. The company completely ignored the safety issue and instead offered a partial refund to keep the defective products when I declined that offer stating that the safety issue was ignored they came back with a second offer of 50% discount to keep their unsafe product. At that point I reached back out to Amazon Customer Service again, I informed them, I no longer wish to communicate with Serwall due to fact that Serwall explicitly ignored my safety warning, and that this should be a red flag that this company disregards safety regulations. FYI, I have copies of all message correspondence between myself, Amazon, and Serwall company if copies are needed. Also I would like to mention, after this incident , I went online to find if anyone else has experience this safety issue and have found some reviews on Amazon site with reports to this safety issue. As a retired nurse, who believes, safety first, I do not understand why they still have this product out there knowing the traumas it could cause and even the liability to them. The lack of a basic locking mechanism presents an immediate, unreasonable risk of injury to children. Requested Action: I request that the CPSC investigate this design defect and mandate that the manufacturer issue a corrective action plan or a formal recall to provide a retrofitted locking latch to all consumers who purchased this unit. Please keep us safe, it saddens me to think some little child could be injured or worse, this tabletop is so heavy the injury could be catastrophic. Also, Im not understanding why Amazon would continue to sell this item for Serwall. I have emailed out two letters, one to, ecr-replies@amazon.com and the other to, cs-escalations@amazon.com as to the safety issue. So far, I have not received any reply.
