The product, in the report: https://www.vortens.com/warranty/ According to forensic engineering consultant [REDACTED], about 2,000 tanks were not subjected to a high enough temperature in their kilns, resulting in a weaker material that is prone to cracking from the water pressure.

PROBLEM: Vortens DEFECTIVE toilet tank crack NOT COVERED under my paid [REDACTED] home warranty contract #[REDACTED].

    G. LIMITATIONS OF LIABILITY 1. General Exclusions. This contract does not cover: g. Repair, replacement, installation or modification of any covered item that has been determined to be defective by the Consumer Product Safety Commission or for which a manufacturer has issued a warning, recall or determination of defect.

Thank you for allowing [REDACTED] the opportunity to serve you.

    Sincerely,

[REDACTED] Customer Relations [REDACTED] Monday - Friday 8:00 AM - 5:00 PM MST

Statement 08/22/24: because manufacturer issued warning, recall or determination of defect, (which was NEVER COMMUNICATED TO ME, UNTIL ONE OF THE TANKS CRACKED/FAILED, PAST THEIR 5-YEAR EXTENTED WARRANTY!). Luckily I was home and was able to minimize extreme water damage and dried everything up with an industrial fan, running continuously for three days, to avoid mold. I have 5 of these Vortens #3464 (2009 15-ENE 461) toilet tank/s in my home and I fear the other 4 could also crack, creating repeated additional catastrophic disasters from these defective units.

What is the best way to force Vortens in taking responsibility? The first of 5 units has now failed and I have experienced water damage to personal property (master closet being on the other side of that wall) but chose not to file an insurance claim even though it resulted in considerable property damage in my closet (i.e., coins, electronic equipment, ties, shoes, etc., in cardboard boxes and/or directly on the floor)! Should I not expect Vortens to at least replace these defective toilet tanks (or complete units), without my incurring costly legal involvement? What are various email addresses to reach out to, for quick action, please?

Response from my paid [REDACTED]: With regard to your Vortens toilet, the crack occurred due to a manufacturing defect and is not a malfunction from normal wear and tear. [REDACTED] will not provide coverage to repair or replace this toilet per the terms of your contract.

Per attached photos, one of my Vortens #3464 (2009 15-ENE 461) toilet tank/s mysteriously cracked from top to bottom, on front left-facing corner, leaking much water. I am the original owner (house bought brand new, Dec. 2009) and I have five of these defective toilets in my home apparently discontinued, waiting for another accident to happen. Importantly, this failed unit is one of two immediately facing private toilets from master bedroom and they must match to avoid being an eye-sore, as well.

07/21/24: customerservice@vortens.com; claims@vortens.com The tank has a brown side-mounted flush lever and a curved tank front and lid, with outer extremity lid measurements being 19.25 X 9”. Do I need to remove toilet tank to determine actual color (it is some sort of off-white color) or is that info already in photos/numbers provided herewith?

The product, in the report: toilet tank

(08/02/2021) The consumer went outside to put the trash out. She noticed water on the garage floor. She looked up at the ceiling and saw that it was saturated with water.
