The product, in the report: Under counter/shelves recessed lighting
Upon discovery that Eurofase lighting fixtures installed in my home were melting I emailed [REDACTED] of the Eurofase Lighting Company on 1/3/2017 the day after I telephoned to inform her about this issue. This email contained 10 attached photos depicting the various stages of the melting problem. All 15 of the fixtures have been damaged. I understand Eurofase changed the UL ratings for their Model/Category R039 lighting fixtures in the late 90’s from 35W to 20W presumably because they became aware of the overheating problem. My [REDACTED] home was built in 2004-2005 with 35 W bulbs in the R039 fixtures.
My complaint is a defective product/product liability claim which is not limited by any warranty provision. The fixtures as equipped continue to pose a serious fire hazard. I have been informed that product liability is not limited by warranty provisions or statutes of limitations. Eurofase remains potentially liable for any damage or injury resulting from this defective product.
