The product, in the report: It is a door mat. I have had door mats at my back door for 46 years and never had one slip because they were made of rubber not vinyl. The newer rugs are clearly marked “rubber bottom to prevent slips and falls” That is an admission that they should be made of rubber. They implied at deposition that I should have researched the product before I purchased it. It is 18 X 28” door mat for indoor/outdoor use.
On 2/29/2012 I was taking out trash boxes. I secured the screen door to open so I could be free to move. I stepped on this rug and it slipped out in front of me. I instinctively grabbed the door to stop my fall, but that just twisted my body around so that therapy landed on the deck head down, left ankle breaking the ankle. I will attach pictures. I bought the rug at Christmas Tree Shops and I contacted them asking them to recall the rugs or at least remove them from their shelves. They refused, so I did file a lawsuit against them. They totally deny responsibility. The bottom of these rugs are made of vinyl. I was not aware of that. They insinuated that I should have researched the item before I bought it. Who researches a purchase like that? If you live south of Atlanta, that is what adults and kids alike use as a substitute sled for rare snow days. I did NOT trip on the rug, the rug slid out from under my feet. It was not icy on the deck. The fire department took me down the ramp. if it was icy they would not have done that. the ramp is a 20” + recline down to the ambulance. I was confined to my house for weeks. The pain in my ankle and leg was at times unbearable. I had to have safety bars put in my bathroom (3) in order to be able to try to stay safe. I had to have physical therapy, occupational therapy and visiting nurses for 3 weeks. I missed for 2 months my trip to Hawaii with my husband. Christmas Tree Shops had zero caring about it. They now sell the same type of rugs in the store plus ones made of rubber marked “reduces fall risk from slips”.. proving they KNOW the risk from vinyl backing. I am almost 67 years old now and I still have pain in that area.
