  1. Death

Made Jan 22, 2018, sent to the company Jan 30, 2018, published by CPSC Feb 13, 2018

The product, in the report: The unsafe product is a “”Stanley 5000 Watt Generator with 6000 Surge/Peak Watts” portable generator. The product was/is sold by SEARS. The manufacturer of the generator is GXI Outdoor Power LLC. The product uses the American brand name “Stanley” but is actually made in China by third-parties.

The unsafe product is a “”Stanley 5000 Watt Generator with 6000 Surge/Peak Watts” portable generator. The product was/is sold by SEARS. The manufacturer of the generator is GXI Outdoor Power LLC. The product uses the American brand name “Stanley” but is actually made in China by third-parties.

This product caused a sudden and spontaneous gasoline leak which lead to a fire and decedent’s death from 3rd degree thermal burns/injuries. Decedent’s wife sustained first and second degree burns and also the emotional trauma of seeing her husband burnt alive, among other things.

The accident took place on 10/27/14 at approximately 11:30 PM in [REDACTED]. The generator was in decedent’s garage and NOT IN USE on the night of the incident.

When retiring to their bedroom at night, decedent & wife smelled an odor and traced it back to the garage on the ground level. In the garage, decedent and wife witnessed gasoline leaking from the generator. Wife tried to obtain rags in the room next door and, upon exiting the garage to the room, the pilot light of the boiler next door ignited the gasoline vapors.

The New City Police Department, Fire Inspector and Fire Department determined the cause of the fire as being the leaking generator. Thereafter, in Nov. 2015, experts for the estate, SEARS & GXI conducted multiple days of joint inspections, including physical inspection, microscopic testing and chemical testing, among other things. The joint inspection found a defective, fractured bolt in the carburetor. The Estate’s experts determined the leak was caused by a sudden fracturing of the brass bolt in the fuel reservoir bowl, in the upper portion of the carburetor. The fracturing of the bolt had caused the fuel reservoir bowl to fall, thereby causing the sudden and immediate leaking of all the generator’s gasoline contents. The experts found that the bolt was made of low quality yellow brass alloy which is prone to corrosion, cracking and dezincification. The experts also found the bolt had intersecting perpendicular bored holes which also caused the fracturing of the bolt. All of the above, among other things, constitute dangerous defects in the product. The experts also found inadequate or non-existent warnings, among other things.

This report is being submitted as three years have passed and SEARS/GXI have still not reported the incident. The product is still being sold in the USA, via SEARS, Home Depot, Loews and Kmart. There is a high likelihood that other American consumers will be injured.
