The product, in the report: Mooncool TK-PRO ELECTRIC TRICYCLE

[PRODUCT INFORMATION] Brand: Mooncool. Model: TK-PRO Electric Tricycle (E-Trike). Purchase Source: Amazon.com. Amazon Order Number: [REDACTED]. Purchase Date: August 16, 2025.

[INCIDENT DESCRIPTION AND SAFETY HAZARD] I am reporting a severe safety event involving sudden full-power acceleration and a non-compliant lithium-ion battery pack. The vehicle was recently assembled following a medical release from post-spinal fusion surgery weight restrictions. The incident occurred on my front porch, which is roughly 5.5 feet deep and features a built-in transition ramp designed to roll the trike safely down to the pavement. I had the trike positioned properly toward the ramp. As I was attempting to mount the vehicle and place my feet on the pedals to ride down, the vehicle suddenly and violently accelerated at full power. I do not remember touching the throttle, though I cannot rule out whether it was an internal electrical malfunction or an accidental brush against the throttle control during the mounting process. Regardless of the root trigger, the vehicle immediately lunged forward with unchecked, maximum torque. The machine caught my shirt on the handlebars, tearing the fabric, and forcefully impacted a heavy-duty stainless steel handrail running alongside the porch. The kinetic force generated by the vehicle was severe enough to rip half of the stainless steel railing structural support directly out of the wooden deck flooring, while twisting and bending the remaining steel framework. Notably, the e-trike frame itself showed no visible damage, as the vast majority of the high-velocity impact was completely absorbed by the oversized front fat tire, which directly transferred the destructive energy into the porch railing.

[INJURIES SUSTAINED] The momentum of the sudden impact violently threw me from the vehicle. My injuries were mitigated only because I managed to grab a remaining upright support rail, slowing my fall down the steps onto the pavement. Over the subsequent 48 hours, impact injuries manifested, including deep bruising across my abdominal and stomach area, a bruised and scraped right knee, and bruising on my left knee. While I thankfully noticed no increase in back pain or structural changes to my spine, an uncontrolled full-power launch of this nature carried an extreme potential for a damaging injury to a recent spinal fusion surgery.

[TARGET DEMOGRAPHIC MARKETING CONTEXT] It is relevant to note that this specific e-trike model is frequently advertised and marketed toward older adults and seniors looking for a stable mobility option. As a 74-year-old rider, I fit this target demographic. Because this vehicle is positioned for older riders, ensuring it has predictable power delivery and robust built-in throttle safeguards is critical to preventing sudden, high-torque accidental launches.

[MANUFACTURER NOTIFICATION AND LACK OF RESPONSE TIMELINE] While Mooncool’s customer service was previously responsive and helpful regarding standard shipping issues like missing parts and paint scrapes during assembly, they completely froze communication regarding the initial safety report. In late July 2026, I sent an initial letter to Mooncool immediately after the accident, explicitly detailing the runaway acceleration and the structural property damage to my deck handrails. I did not mention the bodily bruising at this time, as the deep tissue trauma had not yet fully surfaced. This safety alert was met with total silence for roughly three weeks. On August 16, 2026, I issued a second follow-up letter. The primary catalyst for this second communication was my subsequent discovery through research that the battery lacks mandatory safety certifications. Upon physical inspection of the pack, I verified it completely lacks the necessary physical compliance markings required under California law. I reached out to demand accountability regarding this violation and to update the file with the details of my subsequent bodily bruising.

[HAZARDOUS BATTERY COMPLIANCE VIOLATION] Because the high-power impact occurred while the massive 960 Wh (48V 20Ah) battery pack was fully charged, the compromised vehicle presented an immediate concern for electrical damage and thermal hazards. I surrendered the battery to a local hazardous waste disposal facility to protect my home. Upon physical inspection of the battery casing prior to disposal, I discovered that the battery completely lacks any official, verifiable UL 2271 or UL 2849 safety certification markings. This is a direct violation of California Senate Bill 1271 (SB 1271), which strictly bans the sale of e-bikes or e-bike batteries in California without accredited laboratory safety certification. While the unit may have spent time in an Amazon fulfillment center warehouse prior to delivery, public consumer reports indicate a consistent, widespread pattern of this specific production model shipping to consumers entirely devoid of mandatory UL safety labeling. I have formally requested that Mooncool provide a valid Certificate of Compliance or clarification regarding this statutory violation, and I am currently awaiting their response. Please refer to my attached photographs showing the destroyed deck steel structural supports and my torn clothing.
