The product, in the report: 2023 Can Am Defender HD7 with VIN [REDACTED] BRP is the Manufacturer
I have a 2023 Can Am Defender HD7 with VIN [REDACTED] on my ranch in Benavides, Texas. My son and ranch foreman were doing some work on my ranch. My son drove the Can Am to the location where they were working. He turned the engine off and walked away from the machine to do some work. Within a few minutes after turning the machine off, it caught on fire. They used a second Can Am to push the burning machine into a nearby pond to put the fire out. We took the machine to Neessen Outdoors in [REDACTED] for repairs or warranty replacement. We called BRP to inform them and they opened up a case and case number of [REDACTED]. BRP then denied the case stating there is not enough supporting evidence to indicate a BRP manufacturing defect caused the damage, and without that BRP will not be assisting with the repair. BRP does have a recall for fuel line issues on the 2023 Can Am Defender HD7, but they stated this VIN is not listed and is not affected by this bulletin and therefore does not apply in this case. I do not feel responsible for this fire. The machine caught on fire in the engine compartment and I feel it is a fuel line issue. I can provide photos if needed. I am unable to upload on this site.

The product, in the report: New 2026 Can-Am Maverick 200hp 900cc turbocharged 1620 pound Side X Side Black with blue doors and red lettering. Model 0007XB88
The vehicle is a brand-new, completely unmodified Can-Am Maverick RR UTV with only 202.2 total miles on the odometer, operating entirely within its initial factory break-in period. While operating the vehicle normally on flat, standard terrain, a catastrophic structural safety failure occurred without warning. A critical factory installed structural fastener specifically, the locknut and bolt securing the front drivers side upper control arm directly to the vehicle’s frame backed out completely and fell out of the chassis. This was due to either a complete lack of initial torque from the manufacturing facility and missed by the dealers pre-delivery inspection (PDI) Upon the bolt vibrating free and exiting the frame tab, the structural integrity of the front independent suspension collapsed instantly. The upper control arm separated fully from the vehicle’s frame, causing the entire front wheel assembly, spindle, and tire to fold outboard and violently collapse sideways under the chassis. This mechanical failure resulted in an immediate, total loss of steering control. I was completely unable to steer or control the trajectory of the vehicle, causing it to violently leave the roadway and careen off-road toward a tree line. The vehicle came to a stop within inches of a high-impact collision with a tree. Photographic evidence explicitly shows that the internal empty frame tabs where the bolt and nut are completely missing, confirming that the hardware backed out due to torque failure rather than snapping from an impact.

The product, in the report: 2023 Canam Defender HD10 max, UTV
Owned a 2023 Canam Defender completely stock and while driving with my wife and daughter the unit caught fire. The fire was so intense that there is nothing left but the frame. Ive reached out to BRP (Canam) and filled out a report and they had me drop off the unit at a dealer. They denied any issues and have closed the investigation without even inspecting the unit. They dealer I dropped it off to stated that canam never sent anyone or never had them inspect the unit. There are multiple situations where these units catch fire out of nowhere. There were no injuries. We were causally driving checking our property boundaries driving around 20mph when I felt heat coming from the rear of the unit, when I turned around the bed was completely engulfed in flames. Had I not turned around when I did there would have been severe injuries as the fire engulfed the entire unit within seconds.

The product, in the report: 2018 Can Am Maverick X3 Max RS Turbo R
Re: Report and Request for Investigation and Nationwide Manufacturer Corrective Action Recalls Concerning Imported Bombardier Recreational Products Inc. Can Am Maverick X3 Repeated Sudden Unintended Engine Stalling; Failed Suspension within First 300 Miles of Use; Twice Failed New Side Restraint Safety Nets; Improper Rearview Mirrors; Substantial Risk of Injuries and Unreasonable Risks of Injuries and Death. Dear CPSC Investigators, Please accept the foregoing as a formal report and complaint, request for investigation and recalls regarding substantial risk of injuries to consumers and unreasonable risks of injuries and death concerning imported Bombardier Recreational Products Inc. Can Am Maverick X3 Max, associated vehicles and side restraint safety products. Image 0001
Image 0001 (preceding page) is the subject defective and unreasonably dangerous 2018 Can Am Maverick X3 Max RS Turbo R with 315 original miles. Manufacturer corrective action recalls are necessary concerning four serious safety defects presenting substantial risk of injury and unreasonable risk of injuries and death. Presented infra are four major objectively verifiable serious safety related defects which are substantial product hazards and create substantial risk of injuries to consumers and unreasonable risks of injuries and death. CPSC should request all information inclusive of warranty data, consumer contacts, internal emails, emails to authorized dealers and documents from Bombardier Recreational Products Inc. Can Am, and thereafter seek recalls concerning: 1. Sudden unintended engine stalling or failure; 2. Failed suspension, shock absorbers or steering components; 3. Failed side restraint safety nets; 4. New vehicles sold without proper rearview mirrors; 5. Any other reports to CPSC concerning Bombardier Recreational Products Inc. Can Am offroad vehicles. Image 0001 depicts the subject vehicle in stock condition. No modifications to the engine, fuel intake, computers, exhaust, drivetrain, suspension systems or electrical system have been made. Added to the vehicle are authorized Bombardier Recreational Products Inc.’s accessory rearview mirrors (vehicle should have been equipped with proper exterior rearview mirrors from stock new delivery, see infra), Bombardier Recreational Products Inc. rack, Bombardier Recreational Products Inc. window area side restraint safety nets (window area side restraint safety nets twice failed at new, see infra), and aftermarket replacement wheels and tires (because the original tires only lasted 165 miles and came apart in a very short period of time). Other than the Bombardier Recreational Products Inc. authorized accessories mentioned above and the aftermarket replacement wheels and tires, the vehicle is in stock OEM configuration.
Note: The subject vehicle sits abnormally low in the rear due to failed and leaking rear shock absorbers all within the first 315 miles of operation since new. For a brief history, I purchased a new top-of-the-line imported Bombardier Recreational Products Inc. manufactured 2018 Can Am Maverick X3 Max RS Turbo R vehicle (currently with 315 original miles on the odometer) that has never run or operated properly since new, has serious safety defects making the vehicle in fact unsafe and unreasonably dangerous to operate, that has never been repaired properly by Bombardier Recreational Products Inc., that the engine will either not maintain its idle or will suddenly and unintended stall and stop running, that has populated numerous diagnostic trouble codes and has spent months and months in Bombardier Recreational Products Inc authorized dealer’s repair shop and has not been repaired properly in order to be safe to operate. Bombardier Recreational Products Inc. authorized dealer’s repair shop informed me all four shock absorbers have failed and leaked out (2 completely and 2 partially). Additionally, I purchased separately a set of imported Bombardier Recreational Products Inc. window area side restraint safety nets (to keep heads, arms, body and children inside the vehicle) which were in a failed condition when purchased new (replacements failed as well). All four of these improper and substandard, dangerous and hazardous product conditions merit investigation and recalls because they all present serious and unreasonable risk of injuries and death, the products complained of are substandard and unsafe and must be recalled. The subject vehicle has been in the possession of Bombardier Recreational Products Inc.’s authorized dealer for repairs since mid-December 2023, remains unrepaired and is not in my possession. Bombardier Recreational Products Inc.’s attorney [REDACTED] has been noticed in writing concerning the sudden unintended engine stalling and failed suspension, the very low original mileage of the subject vehicle and its failures resulting in unsafe and unreasonably dangerous conditions associated therewith. Mr. [REDACTED]has failed to respond. I was contacted by Consumer Relations Specialist Ms. [REDACTED] and the matter remains unresolved. Bombardier Recreational Products Inc. generated an internal case number concerning the subject vehicle and it is [REDACTED]. Bombardier Recreational Products Inc. CSR [REDACTED] recently wrote to me via email: “I am very sorry about this experience with your unit. Once it is back in your possession and you can confirm that it is fixed to your satisfaction, BRP would like to offer you some compensation for your lost riding time and overall experience. The compensation is in
the form of a credit towards BRP products and\or warranty extension on your unit.” Bombardier Recreational Products Inc.’s admission and response is insufficient due to the severity and danger of the operational issues encountered, and because after multiple failed repair attempts, the vehicle appears unrepairable and is unsafe and unreasonably dangerous. The subject imported Bombardier Recreational Products Inc., Can Am Maverick is one of many other units with similar defects, dangerous propensities and problems. The compensation offered by Bombardier Recreational Products Inc. Can Am is improper because it seeks to cover up and conceal multiple serious safety defects from the American public in order to avoid product recalls. I. SUDDEN UNINTENDED ENGINE STALLING AND FAILURE TO MAINTAIN ENGINE IDLE. The subject imported Bombardier Recreational Products Inc. manufactured 2018 Can Am Maverick X3 Max RS Turbo R vehicle presents as in new condition with no damage thereto (not even one scratch on the vehicle). The vehicle has approximately 315 original miles on the odometer since purchased brand new. The vehicle has low miles on the odometer because it has never operated and run properly. I have given BRP many opportunities to repair this vehicle but Bombardier Recreational Products Inc. is unable to make it run and operate safely and properly. When the subject vehicle was new its engine did not run properly and would not maintain a constant or consistent engine idle. These conditions have persisted throughout the short life of this vehicle. At attempted engine idle, the engine and tachometer stumbles, hunts and surges and oftentimes the engine stalls out unintentionally and unexpectedly. The subject vehicle’s engine will unintentionally suddenly stop running when in operation and moving forward. Also, when coming to a stop the engine stumbles, hunts and surges and will either stall or recover and run until the next time it improperly stops running. The subject vehicle has improperly stalled in reverse as well. Sudden unintended engine failure is a serious safety defect and is unreasonably dangerous because if the vehicle is in motion and the engine suddenly shuts off the vehicle becomes very difficult to control. If the engine suddenly stops running while on a hill the vehicle can become instantaneously uncontrollable and serious risk of injury or death is present.
Many other Bombardier Recreational Products Inc. owners are posting similar defects, failures and complaints therewith on the internet concerning various engine related problems and diagnostic trouble codes and failure to run or sudden unintended engine shutdown or stalling, engine misfire, limp home mode and other drivability issues. Both the internet posts and videos, and in my situation, Bombardier Recreational Products Inc.’s authorized dealer, state common perceived problems are the drive belt causing engine misfire (design defect [drive belt should never cause an engine to misfire]), potential bad gasoline, spark plugs with too much anti-seize applied when new from the manufacturer and defective ignition coils. Individuals and Bombarider Recreational Products Inc. authorized dealers replace all these parts to no avail as the operability issues remain thereafter. Most of these pieces have been replaced on my unit and the vehicle remains undrivable, unsafe and unreasonably dangerous. In mid-December 2023 the subject vehicle was again presented to Bombardier Recreational Products Inc.’s authorized dealer with an engine misfire code P0303 and in “Limp Home Mode.” The vehicle was allegedly repaired and given back to me a week later. Thereafter I took it on a trip to [REDACTED] and within two miles of operation new engine trouble codes were present and the vehicle’s engine unintentionally stalled a few times. I limped the subject vehicle back to our camp another two miles and parked it for the remainder of the trip due to engine failure. The subject vehicle was again returned to Bombardier Recreational Products Inc.’s authorized dealer with diagnostic trouble code P0131 and has been in their possession for a couple of months and remains unrepaired to date.
Image 0002 Image 0002 depicts the subject vehicle’s instrument cluster at 308.7 miles on the odometer and in “Limp Home Mode.” Diagnostic trouble code P0303 “Engine Misfire” was indicated during December 2023.
Image 0003 Diagnostic trouble code P0303 “Engine Misfire” is shown above. The subject vehicle was taken to Bombardier Recreational Products Inc.’s authorized dealer with diagnostic trouble code P0303 “Engine Misfire” and the dealer claimed to have repaired the vehicle and attributed DTC P0303 to a manufacturing defect of allegedly too much anti-seize on the vehicle’s spark plugs from new. I asked the dealer to retain and provide the allegedly defective spark plugs to me as well as an engine oil sample. Of the three spark plugs used on the engine and replaced, I received only two back. Thus far, no Bombardier Recreational Products Inc. provided guidance or directed repairs to their authorized dealer has repaired the unsafe and unreasonably dangerous conditions associated with this vehicle. Bombardier Recreational Products Inc. is importing and dumping hazardous and unreasonably dangerous products in the United States.
Thereafter, on the express representations the subject vehicle was properly repaired and safe to operate, the vehicle was taken on a trip and again failed to operate properly and the engine stalled multiple times, culminating in a “Check Engine” failure message, see infra. Image 0004
Image 0005 313.1 original miles and the Check Engine failure messages are back and indicated in the subject vehicle’s instrument cluster, see Images 0004 and 0005 supra. A properly running Bombardier Recreational Products Inc. Cam Am X3 Maverick does not state “Check Engine” in the center of the instrument cluster and this message indicates engine failure. The subject vehicle resumed its unintended engine stalling just a couple of miles after leaving Bombardier Recreational Products Inc.’s authorized dealer post alleged repair. Bombardier Recreational Products Inc. and their authorized dealer’s diagnosis of too much anti-seize was clearly erroneous and as evidenced above, the subject vehicle still manifests engine failure problems. These engine failures and defects are substantial product hazards, unsafe and unreasonably dangerous requiring nationwide manufacturer corrective action recall.
Image 0006 Image 0006 depicts the subject vehicle’s most recent diagnostic trouble code P0131 which is allegedly engine sensor related. Image 0001 (first page of this document) was taken after diagnostic trouble code P0131 populated and the engine had unexpectedly stalled repeatedly on the short trip subsequent to its alleged repair for DTC P0303. Bombardier Recreational Products Inc.’s authorized dealer contacted and engaged BRP’s technical services to help troubleshoot the problems. BRP was slow to respond to their authorized dealer. BRP technical services provided writings to their authorized dealer. Please request the emails and writings as they document BRP tech does not know what is wrong with the vehicle and was guidance to their dealer as to how to troubleshoot. It should not take two and a half months (two and a half months for its most recent repair visit and keep in mind this vehicle has been in to be repaired on multiple occasions and remains in a failed state to date) to repair the vehicle if they in fact know what is wrong with it, but they do not know what is wrong with the engine of this vehicle, hence the lengthy delay. Sudden unintended engine shutdown or unintended engine stalling is a recognized serious safety issue and defect in all motor vehicles and offroad vehicles and a recall is necessary and warranted given my experience and the
substantial numerosity of people experiencing these improper operational conditions with their Can Am X3 Mavericks. II. SUSPENSION AND SHOCK ABSORBER FAILURE (ALL FOUR SHOCK ABSORBERS FAILED). All four shock absorbers on the subject vehicle have failed within 315 miles of use and leaked out. Four failed and leaking shock absorbers are a serious safety defect and unreasonably dangerous. According to Bombardier Recreational Products Inc.’s authorized dealer, the rear shock absorbers have completely leaked out (and left witness marks and discoloration of the vehicle’s painted body work) and have failed. The authorized dealer stated these failures are common and recommended an aftermarket company’s products and service modifications to the shock absorbers in order to repair them. The vehicles’ front shock absorbers are presently in the process of leaking out and failed. The aftermarket parts and repair service re failed shock absorbers was declined. Neither Bombardier Recreational Products Inc., nor their authorized dealer have alleged abuse, misuse or unforeseeable use concerning the subject vehicle because the vehicle presents in as new condition, please see Image 0007 below. Image 0007
Image 0007 (preceding page) depicts the subject vehicle and note its low and squatted rear end and failed suspension. The vehicle sits lower than it should because of failed suspension. Image 0007 was taken after just a few miles of operation when “Check Engine” indicated on the vehicle’s instrument cluster, subsequent to its alleged but failed repair regarding “Engine Misfire” and was parked for the duration of our trip. Image 0008
Image 0008 (preceding page) depicts the right rear shock absorber reservoir leaking down (pooling on the horizontal surface, dripping downward on the vertical surface) on to the body work of the vehicle just to the left of the letter “C” for Can Am. The left rear shock is in similar leaking condition and has left a similar mark on the body work of the vehicle as well. According to Bombardier Recreational Products Inc.’s authorized dealer all four of the subject vehicle’s shock absorbers have failed. No vehicle should have four failed leaking shock absorbers within 315 miles of gentle usage and clearly proves product defect(s). Failed suspension affects vehicle dynamics and operation. The subject vehicle is unsafe and unreasonably dangerous because of the deleterious effect to vehicle safety failed suspension presents as related to vehicle instability and operation. Four failed shock absorbers on this vehicle present enough to merit further investigation and recall due to their unsafe and unreasonably dangerous condition. Many other Can Am X3 Maverick owners have suffered similar failure situations so much so wherein a number of aftermarket businesses have developed to redo or repair failed Can Am shocks inclusive of adding an external refill valve to the shocks to make repairing them easier and less expensive. Because of the suspension shock absorber failures the Bombardier Recreational Products Inc. Can Am subject vehicle is undriveable and dangerous. CPSC should request warranty data and consumer contacts from Bombardier Recreational Products Inc. Can Am regarding failed shock absorbers (as well as regarding engine problems unintended shutdown, diagnostic trouble codes etc., and concerning side restraint safety nets). No shock absorber should leak within 300 miles of usage. Because the issue of failed suspension shock absorbers is widespread enough to have spawned an active aftermarket for Can Am shock repairs and aftermarket repair part additions, and the shock absorbers leak and easily fail, a recall is appropriate concerning these dangerous failures of critical vehicle suspension components. Failure of all four of the subject vehicle’s shock absorbers proves the suspension is defective, unreasonably dangerous and must be recalled and remedied.
III. FAILED UNREASONABLY DANGEROUS SIDE RESTRAINT SAFETY NETS. Side restraint safety nets are safety products designed to keep the operator, passengers inclusive of adults and children within the vehicle in the event of a crash in order to avoid ejection from the vehicle and crush and other injuries. Side restraint safety nets are critical safety devices. When this vehicle was new, I purchased four window area side restraint safety nets marketed and sold by Bombardier Recreational Products Inc. Can Am. All side restraint safety nets failed. To be clear, Bombardier Recreational Products Inc. Can Am side restraint safety nets are a safety device intended and used to keep parts of the human body (heads, arms, hands, body, children) contained within the Roll Over Protection Structure in the event of a vehicle crash. The design and manufacture of the Bombardier Recreational Products Inc. Can Am side restraint safety nets are substandard, improper and defective using light rubber bands to keep them secure and in place on the vehicle. The Bombardier Recreational Products Inc. Can Am safety nets utilize a rubber band type mounting system and the rubber bands are not robust and are prone to failing. Due to defective materials hence defective manufacture and poor failure prone closure therefore defective design, the side restraint safety nets and their mounting closures are substandard, failed and are unreasonably dangerous and likely will not keep the adult human body or parts thereof or children within the Roll Over Protection Structure in the event of a crash. The failed side restraint safety nets present both manufacturing and design defects and must be recalled. Bombardier Recreational Products Inc. Can Am safety nets can be seen in Images 0001 and 0007 supra and are mesh nets that hang and are intended to cover and secure the area above the vehicle’s doors and below the Roll Over Protection Structure. The original Bombardier Recreational Products Inc. Can Am side restraint safety nets failed when brand new either before or right after they were installed on the vehicle due to defective materials used in the manufacture of the side restraint safety nets’ mounting apparatus and the replacement set of side restraint safety nets have failed as well. Please see photographic images of the side restraint safety nets dangerous conditions and failures below. Image 0011 (page 16) clearly shows significant failure
unreasonable risks to occupant safety and retention within a given Bombardier Recreational Products Inc. vehicle. Image 0009
Image 0009 (preceding page) depicts the rubber polymere band type mounting system as attached to a Bombardier Recreational Products Inc. Can Am safety net. At brand new and never used rubber polymer deterioration is plainly evident. Note the deterioration of the rubber band and the fractures of the rubber visible all around the band but particularly visible in the inside diameter of the band. These rubber bands are used to keep the safety nets closed and secure and keep adult and child human bodies within the vehicle. These fractured rubber bands are from the first set of four safety nets purchased new from Bombardier Recreational Products Inc. Image 0010 Image 0010 depicts the substandard rubber band safety net closure and vehicle mounting. Note: The rubber band has failed and see all the fractures visible at the inside diameter of the rubber bands.
The design of the side restraint safety nets’ closures are substandard and defective where diminutive and failed rubber bands are insufficient to keep an adult driver’s or passenger’s and or child’s body within the Roll Over Protection Structure in the event of a crash. Image 0011 Note: See the inside diameter of the Bombardier Recreational Products Inc. Can Am side restraint safety nets’ rubber band has failed and has major fractures (resembling saw teeth) in its materials.
Image 0011 (preceding page) was captured the Bombardier Recreational Products Can Am safety nets were brand new and never used. Image 0011 also depicts failure of the side restraint safety nets’ rubber band closures outside diameter with fractures of the materials as well. These rubber bands are intended close and secure the side restraint safety nets to the vehicle. If the closures fail and break then an occupant’s head, arms, hands and body or a child could be forced outside of the Roll Over Protection Structure and crushed or killed due to forces typically present in roll over crashes or other types of SXS vehicle crashes. The first set of Bombardier Recreational Products Inc. side restraint safety nets failed and were replaced by BRP. The replacement second set of Bombardier Recreational Products Inc. Can Am side restraint safety nets have failed in the same manner as the first set. CPSC should request warranty data and consumer contacts from Bombardier Recreational Products Inc. Can Am regarding failed side restraint safety nets. These Bombardier Recreational Products Can Am side restraint safety nets fail to protect from the very harms and injuries they were designed, marketed and sold to the public in order to protect against. The design, materials selection and manufacture of Bombardier Recreational Products Inc. Can Am side restraint safety nets are defective, substandard and unreasonably dangerous presenting unreasonable risk of serious injuries and death in the event or a crash or a roll over crash and must be recalled. IV. VEHICLES SOLD TO UNITED STATES CONSUMERS WITHOUT PROPER REARVIEW MIRRORS. Bombardier Recreational Products Inc. Can Am X3 Maverick four wheeled offroad vehicles are sold without sufficient and proper rearview mirrors likely due to cost cutting measures. These offroad vehicles are sold new with only one rearview mirror located inside the cars. No outside mounted mirrors are provided on these vehicles when sold new. The inside rearview mirror is insufficient and extremely difficult to see out of (usually providing a rearward view of the sky and parts of the vehicle but not the roadway and vehicles potentially behind these offroad vehicle and consumers are forced to purchase additional side rearview mirrors if they want to be able to see
properly behind these offroad vehicles. If for instance a major automaker provided new automobiles or pickup trucks with only an interior windshield mounted rearview mirror the product defect would be immediately recognizable and obvious because drivers need and expect to be able to see behind them and without external mirrors driving would be much more dangerous. Bombardier Recreational Products Inc. Can Am offroad vehicles are sold in an unsafe and unreasonably dangerous condition because they lack outside rearview mirrors and the single inside mirror is grossly insufficient to provide a reasonable and proper view of the conditions behind these offroad vehicles. V. CAVEAT ON IMPORTER MANUFACTURER BOMBARDIER RECREATIONAL PRODUCTS INC. CAN AM’s RESPONSE TO CPSC AND RESPONSES TO BOTH ME AND OTHER CONSUMERS. Many American consumers of Bombardier Recreational Products Inc. Can Am allege vehicular conditions that are defective and safety related failures presenting when the vehicles are brand new or very close to new. Bombardier Recreational Products Inc. Can Am offroad vehicles are imported into the United States. Note: Imported Bombardier Recreational Products Inc. Can Am offroad vehicles can retail for $30,000.00 USD or more. A survey of readily available internet data quickly reveals many consumers have experienced these and similar types of hazards, failures and unreasonable safety risks associated therewith both within the United States and worldwide. Consumer complaints regarding Bombardier Recreational Products Inc. Can Am poor customer service are widespread and clearly depict a company that cares little for consumers or their personal safety. Within the United States many consumers have purchased these vehicles or other similar Bombardier Recreational Products Inc. Can Am offroad vehicles and patterns can be observed re the alleged lack of quality and the prevalence and outright abundance of safety related complaints of engine problems, suspension failures, steering problems, electrical problems are significant and extensive. Nationwide allegations of safety related defects cover most of the product line and the Bombardier Recreational Products Inc. Can Am responses are very similar or near identical, often attempting to delay, deny, defend and disclaim responsibility, are demonstrative of end user (victim) blaming, denial of buyback demands with some even citing an alleged Bombardier Recreational Products Inc. “mandate” against buybacks. Bombardier Recreational Products Inc. does not repair these vehicles properly as my subject Can Am may be viewed as Exhibit A. Many of these vehicles languish, as mine has repeatedly, unrepaired for extended periods of time at Bombardier Recreational
Products Inc. authorized dealers, mention significant delays in Bombardier Recreational Products Inc. Technical Services responding to dealer requests for help troubleshooting inquiries, absence and unavailability of replacement parts and many allege their vehicles being out of service for many months at a time and receiving their vehicles back from Bombardier Recreational Products Inc. authorized dealers unrepaired or improperly repaired and still manifesting serious safety defects. CPSC should give little to no weight to Bombardier Recreational Products Inc. excuses and denials in light of the objective widespread prevalence of consumer complaints associated with their products easily located on the World Wide Web. Each of the dangerous conditions discussed within this report and complaint regarding the subject defective, unsafe and unreasonably dangerous imported Bombardier Recreational Products Inc. Can Am offroad vehicle is objectively observable, verifiable and is unremedied to date. Bombardier Recreational Products Inc. has engaged in a pattern delay, deny and defend tactics with me as well as many other U.S. consumers and has failed to properly repair their unsafe junk offroad vehicles. This report will be submitted to the United States Department of Justice regarding potential violations of 18 U.S.C. § 1961 et seq.
VI. CONCLUSION. Nationwide recalls are necessary concerning all four serious safety defects presenting substantial risk of injury and unreasonable risk of injuries and death. The reported products, both vehicles and side restraint safety nets, have the ability to injure or kill adults and children riding in these vehicles. Bombardier Recreational Products Inc. Can Am has put corporate profits well above proper regard and concern for the personal safety of unwitting and unsuspecting American purchasers of their substandard, defective and unreasonably dangerous vehicles and safety products. The United States Consumer Product Safety Commission is requested to undertake a comprehensive review of all consumer complaints associated with imported Bombardier Recreational Products Inc. Can Am offroad vehicles and their safety related products and seek nationwide manufacturer recalls with regard thereto. Respectfully submitted, [REDACTED]

No one hurt Made Feb 4, 2024, sent to the company Mar 11, 2024, published by CPSC Mar 25, 2024
The product, in the report: Can-Am Defender Max X Mr HD10, Black & Yellow 72 hp, Rotax 976 cc, V-twin, liquid cooled with strategically positioned engine air intake L x W x H 160.5 x 64 x 82 in. (407.6 x 162.5 x 208.3 cm)
2019 Can-Am Defender Max X Mr HD10, spontaneous fire, incinerated side-by-side minus frame and bumper; I was using utility vehicle ([REDACTED]), no injuries occurred. I drove the machine from my house to end of driveway to pay tractor for pulling my truck out of the ditch (drove 1/2 mile)(heavy snow and ice storm affected Tennessee). Machine was turned off for 10 minutes while I paid the tractor guy. Turned it on to drive home and went 2/5 mile and high temperature gauge came across dash. I turned off machine, took keys out, and walked home 3/5 mile down driveway. As I was walking up to house my wife came out and notice smoke in the distance. We drove our vehicles immediately to side-by-side and it was engulfed in flames, already nearly melted down. Fire department came and put out remaining fire which at that time was mostly burning rubber from the tires ashes. Entire machine other than frame and bumper was incinerated. Conditions - unusual heavy snow in Tennessee. Current recall on 2020/2021 Apache model for snow clogging CVT intake “The stock CVT air intake can become completely obstructed with snow causing the drive belt to overheat and break, posing a fire hazard.” Recall on BRP site specifically states other models are not affected and I believe this to be false. They specifically state The heavy snow conditions created similar environment to Apache models posing same risk. Machine was in excellent condition, just over 100 hours. BRP website states that snorkel version does not need update with recall “If your vehicle is NOT modified with a track kit Your vehicle does NOT need to be updated. “
I feel this to be inaccurate as heavy snowfall likely caused obstruction of CVT air intake leading to high engine temperatures and spontaneous fire even after engine was turned off. The safety of my children and anyone riding in the vehicle could have been compromised if I had not immediately stopped, turned off machine, and walked home. I feel Can-am knew about this problem and did not inform owners of possibility. There are recalls dating back to 2013 regarding exhaust clogging with leaves (January 29, 2013). Machine was not being used in any extraordinary manner.
I can provide pictures when requested.

I was using the 2023 Can Am Defender HD9 we had just bought in April of 2023. It had less than 16 hrs. on it. I was clearing road ways along the property lines. I heard a noise that sounded like pressure being released, like a line blowing. When I looked behind me there were flames coming up around the sides of the bed and from between the bed and cab. I put the UTV in park and jumped off. Only injuries would be from exhaustion and shortness of breath from trying to contain the fire until the fire department could get on scene.

I own a 2015 can am commander manufactured by BRP vin [REDACTED] while ridding in the vehicle I could smell gas fumes. After investigating I found my fuel tank under the passenger seat to have a leak in it. The leak was on the underside of the filler neck around the welder joint where the neck is welded on to the fuel tank. I am concerned as this leak is directly under where the passenger is sitting and if the fuel ignited the user could be seriously burned. There is no apparent damage to the vehicle or fuel tank and this appears to be a manufacturing defect.

The product, in the report: Side by side 4 seat all terrain vehicle
I purchased my Can-Am X3 Maverick Max in September of last year. After less than 100 miles, I took it to the dealership because the steering wasn’t responsive. The dealer told me it was normal. I took it out again, and the steering was so poor that it stopped working altogether, and locked in a turned position resulting in a near rollover of the vehicle. I took the vehicle in yet again, and the dealer replaced the power steering motor. It has made no difference, and the steering has actually worsened. Parked on concrete, I cannot steer the wheel with one hand. In 4wd, it is impossible to steer unless the vehicle is moving. Can-Am and BRP know this is an issue, and have even updated the steering motor in the 2019 units, but the 2018 owners have no option. The vehicle becomes inoperable and unsafe.

Complete loss of steering on 2013 can am commander 800 XT. My wife and I were utving in the Black Hills July 4,2016 weekend when I experianced a complete loss of steering at the end of a 92 mile ride. Luckily we were only going 5-10 miles per hour whenI turned at a gas station and heard, snap and then no steering. This happened after having the steering inspected by a can am dealer 200 miles prior to the incident. We were very lucky because our ride during the day involved some mountain trails that would have been potentailly deadly had it failed then. Can am has dragged their butt on this issue that they have known about for quite some time.

I have a 2013 can am commander that had the steering completely fail while I was driving it, the steering column where it fits into the steering rack is totally stripped out and the steering wheel spins freely with no movement at the steering rack. This seems like a problem that was in a recall for 2011 and 2012 models, but is apparently not covered with my 2013 model. This repair is estimated to be over $650.

This is the second time in 1 year that the Steering on my 2013 Can Am Commander was completely lost while I was driving the vehicle. No substantial injuries were sustained but very well could have been as I was riding through wooded trails. The Coupler that goes between the DPS and Rack is completely stripped out just like the first time this happend. My steering wheel just spins my wheels do not move. This is very dangerous and some one can get injured due to this issue. There are many people reporting this same issue and it seems to be recurring. BRP needs to issue a recall on this and repair this steering problem before some one ends up dead.

Steering coupler that uses a splined coupler with single bolt to provide clamping force to join the steering shaft from DPS to rack and pinion failed causing complete loss of steering to the unit. This is a potential loss of life issue that can am has addressed in the 2011/12 models but has failed to address in the 2013 model commanders. In 2014 they changed this coupler to a 3 bolt design that is an indication of can am’s awareness of this problem. Can am needs to put a recall into effect as soon as possible to get these units out of service.

While riding through the woods checking my deer stands and food plots the steering went out on my Can Am Commander 1000XT. I lost all steering ability of side by side and hit a ditch and a tree. This is the second time this issue has occurred with this same Can Am Commander 1000XT. On 12/14/2014 while riding in the woods I lost all steering ability and hit a tree. The steering couple between the power steering unit and rack and pinion had completely stripped out. BRP replace the power steering unit, coupling and rack and pinion system with all new parts and assured me the problem was fixed and would not happen again. Five and a half months later the same exact issue has occurred again. The coupling has stripped out and failed again causing total lose of control of the side by side vehicle.

The product, in the report: Off Road Vehicle
The consumer and his son were riding in the off road vehicle and had been driving for approximately 3 minutes, when he lost control of the steering wheel. The consumer was traveling very slow, so he and his son were not injured. They were not injured. The vehicle had to be towed back to his home.
The vehicle was serviced in 2011 for a recalled air filter. This may have been a service bulletin, because there isn’t a recall for air filters on the CPSC’s site.
The consumer called the manufacturer after discovering Recall Alert 13-718, but the mfr’s rep. told him that his vehicle was not included in the recall. The consumer asked the rep. what should he do from this point. The rep. told him he could contact customer care to see if it was under warranty, but he did not offer anything else to the consumer.
The vehicle has less than 1000 miles of use since the consumer purchased it.
The consumer said he paid $14,900.00 for the vehicle.

Re: Can-Am Commander Steering Failures
Product Safety Administration:
I purchased a 2013 Can-Am 800R Commander in November, 2012 from Four Seasons Motor Sports in Rye, Arizona. On the 11th of this month I was helping a friend on his elk hunt and shortly after coming down a very steep hill, the steering on my machine went out like snapping you fingers. Fortunately, I was going slow enough that I was able to stop before hitting a tree.
Since then I have discovered that you issued a recall on the 2011 and 2012 Can-Am Commanders for this very problem. I have also been able to ascertain that the same coupler that failed on these recalled models is the same coupler on the 2013 models.
I phoned your corporate office and after explaining my circumstances, I was informed that my machine was not included in your recall. I was told that if I took it to a Can-Am dealer for repairs that the dealer could open a case or claim for me and I might be reimbursed. I have done just that and my machine is now at Four Seasons Motor Sports in Rye, Arizona.
My real issue here is that it is obvious that BRP is aware of the danger with these faulty couplers. The coupler that has failed on 2011-2013 Commanders has been modified on the 2014-2015 models. It now has more bolts holding it in place and one that is supposed to stop the unit from sliding down and uncoupling.
If you look on the “Can-Am Commander Forum” you will see that my problem is not an isolated issue. Steering loss on Can-Am Commanders is happening all over the country. If you do not step up and correct this faulty coupler, someone is gong to be seriously injured or KILLED. I have been in several places with my machine that would have proved fatal if the failure had occurred.
I thought I was purchasing the best UTV available when I purchased your machine. I now have serious doubts and have safety fears if I keep the machine after it is repaired. I implore you to take the necessary steps to correct this issue before you are involved in a class action lawsuit because someone has been permanently disabled or killed.
Seriously Concerned,

The product, in the report: Can Am Commander 1000XT
I have a 2013 Can am Commander 1000XT. My wife and I were riding down the dirt road and lost control of steering. The steering wheel would turn in complete circles and wheel never changed direction. I took this to the Can Am dealer( Jackson Motor Sport) in Pearl, Ms and had this repaired. It was the rack and pinion that went out.

The product, in the report: 2013 can am commander 800 dps vehicle is unmodified except roof windshield and front bumper
2013 can am commander, wife and I were trail riding our 2013 can an comander and with no warning the vehicle lost steering control. During inspection I noticed the connection of the steering colum to the rack and pinion was striped and connecting bolt was still tight. Brp has a safety recall regarding this issue but My Vin # [REDACTED] was not covered under This recall. BRP would not give Me any details on the defect since My Vin didn’t fall under the recalled vehicles. This is a huge safety issue and the current recall needs to be expanded, My Wife and I were not hurt but this is vehicle capable 70 + mph not mention the over $500.00 repair bill I have to pay for a safety issue BRP is fully aware of. Thank You for Your assistance in this matter.

The product, in the report: UTV
The caller stated that while operating the off road vehicle on the ATV trail, for approximately 3-4 hours, the unit started veering to the right although he attempted to veer to the left, the steering wheel would not yield. He collided unto the side of a tree with the front right wheel because the steering wheel would not steer correctly. There were damages to UTV , no injuries were sustained from this incident.
He feels he experienced similar problems of Recall number: 13-718. Hazard: Improper assembly of the steering column to the rack and pinion can result in the loss of steering control, posing a risk of serious injury or death to the user, passenger or bystanders.
The UTV was taken to a dealer when they contacted the firm they were informed that his model was not part of the recall.
The caller is concerned that this vehicle is a safety hazard and should be included in the recall.

The product, in the report: 2012 can am commander 1000 camo utility vehicle
Hi, I bought a new can am commander side by side. I took it out one time and bent the tie rod. I only have 16 miles on the unit. Took it back to dealer and they called can am. Can am claimed that it was my fault. I was looking on line and I see that there is a lot of people that are having this problem. The dealer told me that they have had this problem with other units. Can am claims that they have improved the tie rods. Witch makes me believe that they know there is a problem. I was only going ten miles per hour. They claim that unit goes over 60. I have put the unit for sale because I would not my father or child to drive this UTV at 40 -50 mph and have the same problem. I do not want to have a funeral on my hands 16 miles and 3.4 hours of use. They are going to kill someone Thanks
