  1. No one hurt

Made Apr 17, 2012, sent to the company May 9, 2012, published by CPSC May 23, 2012

The product, in the report: DR70 Dirt Bike

Caller purchased a DR70 dirt bike October 14, 2011 as well as helmet, gloves and other riding safety equipment. Sales reps name is [REDACTED]. Seven months after it was recalled. Bike is recalled March 9, 2011 with release # 11-159 and then reannounced April 12, 2012 with release# 12-150. The family had problems from the very beginning of purchase. Within the first three days the bike was smoking, the brakes were not working properly which caused a tire to burst. October 17th, caller took bike to Quick Pawn & Loan, where an acquaintance [WES] advised her that the bike was not put together at any level. October 19th, 2011 caller took back to retailer to have repaired. Retailer representative advised caller that bikes are not assembled in the store, they come already assembled and only gas needs to changed from dry gas. [redacted] took bike in only because caller was frustrated and was leaving bike in parking lot, he put the bike in the back room. She was given a replacement bike that had all of the same problems. This bike appeared to be older that the first bike but she was getting a very large discount so she took it. Bike is the same model, same vin of L98 and same issues. It is recalled and had been recalled before caller ever purchased it. Caller during this time was able to speak with someone at Baja who told her to take it to a repair shop they were instructing her to take it to. She picked bike back up November 9th, 2011 and she took the bike to Derita Small Engine Repair where [REDACTED] repaired the bike according to the problems they had been having since purchase. She picked bike up from [REDACTED] She began allowing her son to ride the bike but it was still having multiple problems so she took it and parked it in the backyard. While we were talking the caller’s son brought in two pairs of pants that had been burned but that he had hidden thinking he would be able to ride the bike if she didn’t know about them. Today, April 17th she received a letter advising her that the bike was recalled March 9, 2011 which was 7 months before her purchase of the bike. She is livid, her son was able to ride the bike 3 days out of the 90 days, it was on recall the entire time, she feels very betrayed and she would like this bike replaced with a safe, non recalled bike at manufacturer expense.
