U.S. Consumer Product Safety Commission Attn: Report Unsafe Product

Dear commission safety representative, I am writing to report an unsafe product, a mobility scooter purchased from Progress Mobility on March 3, 2021. The scooter was manufactured by E-Wheels. I could not locate a serial number on the scooter itself, but found this serial number on the charger: SS190600353668.

The first time I attempted to move this scooter on/about March 30th, the bar supporting the seat broke, sending me backwards onto the concrete surface of my garage, where I was injured. I fell backwards and have had recurring neck and shoulder pain since then. I contacted Progress Mobility multiple times in an attempt to resolve this matter. I spoke with both [REDACTED] in customer service, and with [REDACTED] , the customer service supervisor. (They have refused to issue the requested refund, and no longer return my calls.) [REDACTED] stated that there is a weight limit for this product; I informed him I am approx. 100 lbs. below the stated income limit of 325 lbs. I was then told by [REDACTED] , Customer Service Supervisor, that the manufacturer (E-Wheels) told her I raised the seat beyond it’s height tolerance limit. I reviewed the set-up instruction manual, which states any of the 3 pre-drilled holes can be used to adjust the seat height (I retained this manual should you need to refer to it). I did not add another hole to adjust this seat beyond its’ limit. I received a replacement part (not sure if it came from the manufacturer or from the distributor, since there was no accompanying paperwork.) The part I received is not the part that broke, and further, I am afraid to replace the broken support post with the same post for fear it will snap again thus causing further injury. I can’t reach Progress Mobility. [REDACTED] , the Customer Service Supervisor, does not answer her phone or return my call. Most recently I was told she’d call me on 4-12-21, and again on 4-13-21. Today is 4-15, and she still has not returned my call.

I feel that this product poses a safety risk. Please review this product and feel free to contact me at the number shown above for further information/photos.

    Sincerely,

    [REDACTED]
