  1. Hurt, no treatment

Made Apr 2, 2012, sent to the company Apr 10, 2012, published by CPSC Apr 24, 2012

The product, in the report: I purchased a dining room table with two chairs (part number ZSH 19500314) for my mother from Bob’s Discount Furniture Store of Yonkers, NY. Please see the scan below of the receipt. They were delivered on February 1, 2012. On March 16, 2012, I was dining with my mother. I moved the chair back one inch to get something. The Bob’s chair’s front leg snapped off and I went falling onto the floor. I hurt my hip and back from the fall. Attached please find the photos of the broken leg and chair. The wood appears to be made of sawdust and glue. On March 17, 2012 I went to the Bob’s Store with the broken leg in hand. Their customer service representative handed me a phone and told me to call their 800 number for help. I spoke with the customer service representative and then the customer service manager on the phone. I explained that my mother, age 89, had a partial hip replacement surgery three months before. I was very thankful that she was not on the chair that collapsed, or she would have hurt her hip again. I asked the manager for my money back. The purchase price with tax was $249 for the set. The manager told me that Bob’s policy is that once the furniture is in the home, they do not grant cash refunds. However, they would give me a credit on the purchase to buy another table and chairs. A salesmen inside the store showed me an array of other chairs However, when I inquired about the quality of the wood, and even showed him the broken leg, he told me that all of Bob’s chairs are made of the same Asian hardwood as that of the broken chair. I went back to the customer service desk, dialed the 800 number again, and told the representative on the phone that I could not risk having my mother sit in another chair potentially as dangerous as the broken one. My mother uses a walker, and she is in a fragile state. I am appealing to your agency to sanction Bob’s Furniture for selling inferior quality furniture that is potentially dangerous for consumers. Furthermore, Bob’s policy of not giving refunds on clearly defective merchandise is unprofessional and unfair. It should be subject to consumer protection laws. Your assistance in forcing Bob’s Furniture to grant me a full refund would also be most appreciated.
