  1. No one hurt

The product, in the report: Van Teal You Will Remember Collection: Curvy Lady Two Torchiere Floor Lamp This Van Teal item is offered in a weathered steel finish. Requires one 250-watt halogen bulb. Curvy Lady Too Floor Lamp If you want a torchier that stands apart from all the others the curvy lady is for you. Sweeping lines and acrylic shade makes this a real addition to any décor. Finish: Weathered Steel Light Bulb: (1)250w T10 Med 120v Halogen [Compare Bulbs] Materials: Metal, Acrylic Voltage: 120 volt Installation: Dry Locations [Explain] Listing: help Number of Lights 1-Light Bulb sold separately Dimensions & Weights Height: 5 feet 10 inches Shade Diameter: 21 inches Made in China

I purchased a Halogen Torchiere Lamp: “Curvy Lady Two” from the You Will Remember Collection by the Van Teal Manufacturer at ATGstores.com on November 29, 2014. The lamp did not come with an instruction manual or a bulb. In the description of the lamp on the ATGstores.com web site, it recommended a 250 W 120V Medium Base Bulb. I was not able to locate this bulb in my area (Dallas, TX), so I called the Van Teal Company directly and was instructed to purchase a [REDACTED] 250 W Halogen Bulb model # [REDACTED] from [REDACTED].com.

This lamp is constructed with the Halogen bulb socket on top of the lamp, with a circular shaped acrylic shade positioned under the socket. There is NO protective covering for the bulb and the bulb is totally exposed on the top of the lamp. (See attached photo)

The back of the [REDACTED] Model # [REDACTED] Bulb packaging has a specific precautionary warning about the safety of the bulb. It states “Halogen bulbs operate at high temperature and pressure, and they could unexpectedly shatter. Use bulb in an ‘enclosed fixture or with a ‘protector’ in front.” (see attached photo)

Due to the halogen bulb having no protective covering, this lamp is a fire hazard and a risk for causing bodily injury. The bulb packaging clearly warns that the bulb is capable of shattering and should only be used with a “protector.” In my online research, I found information stating that all halogen torchiere lamps manufactured after 1998 were required to have a protective shield over the bulb.

I contacted ATGstores.com where I purchased this lamp and told the Service Representative the safety issues. I told the representative that this lamp should not be sold and needs to be recalled. When I asked for a return authorization, I was told that I have “buyer’s remorse” and would be responsible for the return shipping!!

I am concerned that this lamp is NOT safe for the consumer to use. It potentially can cause severe bodily injury and/or property damage. These are the reasons this lamp should be recalled: 1. The halogen bulb can shatter projecting hot shards of glass. 2. Anything that comes in contact with the hot halogen bulb will burn, i.e. Kids’ toys thrown too close to the bulb, and flying insects will catch on fire if they get too close.

I am also concerned that there may be additional Halogen Torchiere Lamps manufactured by the Van Teal company that also have the same safety issues. (http://www.vanteal.com/index.php/category/view/2/Residential)
