The reports, as CPSC published them

Reports people made to the U.S. Consumer Product Safety Commission. CPSC publishes each one after sending it to the company named, and doesn’t guarantee they’re accurate. A report isn’t a recall.

  1. No one hurt

Made Oct 9, 2023, sent to the company Oct 11, 2023, published by CPSC Nov 1, 2023

The product, in the report: Dillon Wall Hugger in Dark Cherry Finish futon frame

On June 22, 2023, we purchased the Dillon Wall Hugger in Dark Cherry Finish from The Futon Shop and received the frame on July 18, 2023. We put the frame together according to the manufacturer’s written and video instructions; however, for a month or so, no one slept or sat on it because we were waiting on a shipment of a specialty futon mattress from another company.

The frame cracked in multiple areas within less than a week of our teenage son of ~160 lbs. sleeping on it. On September 4, 2023, I called The Futon Shop to notify them of the situation, stating that my child could have been seriously injured. I followed up on the call by emailing photos of the defective frame and asking for a refund.

On September 6, 2023, The Futon Shop promised me via email, “I am having the manufacturer ship you a new reinforced queen body for your frame. This will have zero issues and be made stronger. I apologize for the inconvenience and will send you tracking info for this once it ships out.”

I understood this meant the manufacturer would fix the problem and send me a new, safe, reinforced frame. They did not.

Instead, The Futon Shop shipped, from their warehouse, the slatted part of the frame only despite the original frame having cracked in multiple areas and not just the slatted ones. The Futon Shop had the manufacturer send me four additional small slats in a separate shipment that I am supposed to attach to the slatted part of the frame to “fix” the problem. The instructions included with the four slats are poorly written, lack sufficient details, and appear hastily written. According to The Futon Shop, I am supposed to remove the original slatted part only from the defective frame and then attach the slatted piece with additional slats to the cracked main bed frame. I never agreed to do this. It does not solve the problem and is, therefore, unacceptable. I asked for a refund, which The Futon Shop refused, and my bank is now seeking on my behalf.

The Futon Shop has admitted in writing to us and the [REDACTED] that the frame is defective. Despite this admission, The Futon Shop refuses to acknowledge that the frame is a potential safety hazard, provide an adequate solution to fix the problem, or recall the product and notify past and future customers of the safety concerns. On October 4, 2023, The Futon Shop emailed me, “I understand your concerns with the frame breaking. This is not a safety hazard it is a warranty issue with the futon frame.”

Neither The Futon Shop nor the manufacturer has provided proof that they adequately researched the safety issue and that me adding the four small slats to the defective frame will make it “zero issues and be made stronger.” It is not my job as their customer to fix their defective product, and I will NOT risk our son’s or anyone else’s safety.

Please investigate this situation. It is a safety hazard that neither The Futon Shop nor the manufacturer will address. I will provide any additional details. Thank you for your time and attention.
