The product, in the report: Clayton 7 PC Dining Set Taken from Sears.com product description: Including six sling dining action chairs and a tempered glass dining table, the Clayton 7 pc. Dining Set is the perfect outdoor patio option. Host dinner parties and entertain guests with a wonderful dining set that is built to last.
I purchased a patio set from Sears Hardware in June or July of 2011. It is branded as Garden Oasis Living Outdoors, and is the “Clayton Series”. On May 27, 2012, my wife, mother-in-law and two adult guests were sitting around the glass topped table when it spontaneously shattered. No one was touching the table, nothing had just been laid on the table, nothing fell on the table, the table was not over-loaded, the table was primarily if not entirely in the shade (aftermath image available) . It just exploded.
My wife, mother-in-law, and one of our guests received minor cuts from the flying glass.
I returned to the Sears store the next day - May 28, 2012 - and was told that they cannot do anything with returns after 9 days. They directed me to look for the set’s owner’s manual and to call the 800 number listed.
I found the manual and called the number on May 29, 2012 and reached a company called Numark Industries [ 800-457-4652 ( http://www.numarkcustomerservice.com ) ]. They stated that glass breakage is not covered under any circumstance. I asked if they knew that this was apparently a common occurrence and that what they were selling was a dangerous product. I was again told that glass breakage is not covered under their warranty. I pressed the issue and explained that according to news reports/videos available on-line detailing a class action lawsuit filed against Martha Stewart Living, K-Mart, and other entities - my table looks identical to the ones that were complained about. Again I was told that the glass was not covered, and then they hung up.
