Emergency room Made Nov 16, 2020, sent to the company Dec 14, 2020, published by CPSC Dec 30, 2020
The product, in the report: Rubbermaid shelving units. This particular item is 10” x” 36” with part number 1863232 Model 1863232 UPC 0 71691 47289 6
This is the email I sent Rubbermaid on November 9, 2020 that has not received a response. We purchased two 3’ Rubbermaid shelves (#1863232), and appropriate tracks/brackets per the 4 step instructions on the label for the shelving unit. In the 4 step instructions, the diagrams clearly indicate the use of single hole tracks and single hole brackets for the assembly (see attached photos). Given the lack of ANY written information, we relied upon the diagrams for our purchase decisions.
After having someone install the units, my significant other began placing items on the shelf, with the result that the shelf fell down and broke her toe.
Upon reflection, I cannot see how you could recommend this mounting system for these shelves or for ANY application for that matter, as this system provides NO WAY to attach the shelves directly to the brackets.
You do sell a double hole track and double hole bracket system for mounting, which allows for attaching the shelf directly to the bracket, BUT THAT IS NOT WHAT YOU SHOW IN YOUR INSTRUCTIONS!
Your instructions also show placing the track and bracket no more than approximately 1” from the end of the shelf, which is also EXTREMELY DANGEROUS without connections between the shelf and the bracket. This is in fact what also contributed to the accident, as the single hole brackets are NOT LATERALLY STABLE. That, in conjunction with the warps in the shelves themselves, led to the accident, as the brackets will shift laterally FAR MORE than the 1” leeway shown in your installation diagram.
After getting her home from the emergency medical center on Saturday, I returned to the Lowe’s store where I bought these items and confirmed that Rubbermaid DOES NOT sell a supplemental bracket that attaches the shelf to the single hole bracket, so I had to choose between ripping out the whole system and starting over again, or figuring out a way to solve the problem myself. I ended up buying some electrical conduit brackets as shown in the photo attached.
The single hole tracks and bracket system is clearly not appropriate for this application, and you are negligent in showing an installation protocol that does not specifically show AND REQUIRE the use of the double hole/double bracket system. To continue using these installation instructions is materially misleading and is subjecting your company to future lawsuits and liability claims.
We will be sending in medical bills, x-rays, etc. as well as potential worker’s compensation claims based upon her potential inability to continue working during her healing process. Please respond with the specific items you will need, and what you will reimburse for.
I look forward to your prompt response.
