The product, in the report: James Counter Stool/ Bar Counter Stool Model: 98960K Serial Number: 61580814

February 9, 2018 I purchased a James Counter Stool at Kohls.com on RE: Feb 15, 2018- Stool delivered Feb 16, 2018- I assembled the stool (no need to assemble seat cushion because it was already put together in one piece). I simply put the legs and back together. I sat on the (already assembled) seat cushion and sat on a nail. The nail injured me by poking a whole in my right buttock and caused me to bleed pretty badly. I immediately jumped up from the nail and jerked my back. In turned, triggered pain in my butt and lower back. I’ve had a history of back pain specifically degenerated disk, a small tear with sciatica. Feb 16, 2018- I called 800 Kohl’s number immediately after I sat on nail. [REDACTED] transferred me to Supervisor [REDACTED] gave me his contact info. He apologize and said he would forward this incident to Kohl’s corporate HR office because an injury was involved. Feb 21, 2018- I called [REDACTED]. The Correspondence Lead that sent me the email several times. Feb 28, 2018- I called [REDACTED] and left a detailed message. [REDACTED] called me back at 11 :47am. ? I informed her, I was injured pretty badly due to the nail. ? She asked, if I received medical attention. ? I told her, No. ? She said, Kohl’s would refund me the money, she will close the case and to throw away the chair.? I asked, If they wanted to look at the chair to see the nail.? She said, No need to and the postage would be too much for them to pay for shipping. ? I reminded her I was injured pretty badly, caused bleeding and pain. Why wouldn’t they want to look at it?? She said, she would forward the case to the manufacture of the company who makes the stool and they would get back to me either by email or phone. ? I was given no anticipated time/day someone would be in touch or if they were going to contact me by email or phone. Since the incident I’ve have bad back pain that’s been triggered since the event. When I nearly jumped out of the chair, I twisted/jolted my back and it’s causing pretty moderate-severe pain. I also have scaring on my right buttock due to sitting on the nail. I haven’t heard back from anyone since.
