  1. Emergency room

Made Oct 20, 2021, sent to the company Oct 22, 2021, published by CPSC Nov 5, 2021

The product, in the report: Folding barstool with a back. the circular seat is upholstered with a brown material that is similar to suede. The frame of the chair is some kind of black metal. I bought these barstools in a set of two. In the attached photos, I have photos of the broken barstool and the unbroken barstool.

I was at home, sitting on a backed barstool (I purchased it at Goodwill a few years ago. The tag says “Walmart.com” and I have the barcode) at my kitchen table when the barstool suddenly gave way and I fell, hitting my chin on the table and hitting the back of my head on the kitchen floor. I weigh 99 lbs, so I should have been well within the weight limit for this chair. I received minor cuts on my elbow and neck. I went to the emergency room an hour later because I was feeling unbalanced. A doctor examined me and told me I likely have a minor concussion that will improve after a few days of rest. The doctor did not recommend imaging.

  4. No one hurt

Made Feb 15, 2020, sent to the company Mar 10, 2020, published by CPSC Mar 24, 2020

The product, in the report: Barstool with backrest, foldable. Metal frame. Seat is 24” high. Brown.

A metal-framed barstool, one of three, purchased at Walmart in 2019, suddenly collapsed straight to the floor. I’m pretty durable, but I was surprised that no bones were broken -- but it was quite a fall which has tremendous potential for harm. If my chin had been over the bar when the stool collapsed, I can’t imagine my neck not snapping with the violent movement. The weight limit stated on the stool under the seat, is 300 lbs. -- and no one even close to that weight has ever sat on the stools. I examined the barstool to understand what happened and saw that two welded places had actually torn away from the metal tube they’d been attached to. I looked at the other two matching stools and saw that one of them showed the same process, as the weld was already partially separated from the tube -- which means that the next person to sit on it would probably be a victim of the poor quality and design. My 92 year old mother-in-law, currently recovering from a broken knee, may have been the next person - -and I imagine it would have been tragic. I took the stools to Walmart and told them about them -- and they clearly didn’t care. I called and left a message, and I emailed Cheyenne Products named on the bottom of the seat telling them about the danger -- and told them that I have no intention of suing them but the stools are dangerous. I received no response. I was going to throw the stools in the trash -- but my conscience would not allow me to do that, knowing that people can be very harmed if these are not recalled. The design is flawed.
