  1. No incident, no one hurt

Made Nov 22, 2023, sent to the company Dec 5, 2023, published by CPSC Dec 27, 2023

The product, in the report: Mattresses manufactured by Foshan Aiyi (China) or associated companies and imported under “Molblly,” “S Secretland,” “Iyee Nature,” “Jingxun,” “Jingwei,” and “OYT” brands

At the direction of CPSC staff (email from [REDACTED], 11/15/23), we are resubmitting the following through SaferProducts.

A client in the mattress space (“Company”) has identified certain [REDACTED], [REDACTED] and [REDACTED] listings for mattresses manufactured by Foshan Aiyi (China) or associated companies and imported under “Molblly,” “S Secretland,” “Iyee Nature,” “Jingxun,” “Jingwei,” and “OYT” brands whose labels do not appear to comply with CPSC’s flammability regulations at 16 C.F.R. Parts 1632-33. The attached document contains images of the law labels for each of these mattresses. As reflected in these images, such as those pertaining to the Molblly 12-inch hybrid mattress in queen size sold under ASIN B0BTV4LHTG, many of these labels appear to lack information that is required under CPSC’s regulations, such as the manufacturer’s name and address, the month and year of manufacture, the location where compliance records are kept, and the specification of the intended foundation.

Similarly, though beyond the scope of CPSC’s regulations, Company has identified apparent attempts by Foshan Aiyi to evade antidumping and countervailing duties enforced by U.S. Customs and Border Protection (“CBP”). The Company has filed an allegation with CBP pursuant to the Enforce and Protect Act (“EAPA”), and understands that CBP is investigating these apparent attempted duty evasions and potential mis-identification of the country of origin for these imports.

The Company believes that the trade and customs issues, an element of which relates to trans-shipment and mis-identification of the country of origin, are furthered by the lack of identification of the manufacturer on the law label. This creates an overall environment where the consumer cannot be sure of where its product comes from, and undermines CPSC’s ability to trace these products back to the manufacturing source, complicating any potential CPSC investigation or enforcement and potentially frustrating consumers’ ability to pursue remedies in the event of a recall.

The extent to which these apparent labeling deficiencies and customs mis-classifications may be correlated with substantive violations is unclear, but Company does not believe such concerns can be ruled out. In the interest of consumer safety, Company requests that CPSC obtain and test samples of Molblly mattresses and also ensure that any mattresses sold in the Unites States satisfy the labeling regulations and enables CPSC and consumers to understand who actually made a particular mattress.
