  1. Emergency room

Made Jun 11, 2022, sent to the company Jun 14, 2022, published by CPSC Jun 30, 2022

The product, in the report: Daikin High Efficiency Heat Pump and Air Handler. Model: DV37PECC14. Model Desc: Air Handler C-53 EEV. Manufacture Date: 11/01/2021. Serial Numer: 2111000135 (This information is from the Diakin portion of the Warranty I filed with Daikin). There is an inside air-handler cooling and heating system and an outside compressor unit that are both part of the complete system.

Wingate Mechanical company in Cincinnati, OH installed a Daikin HVAC system in my home. The system is producing noxious fumes. I had my home tested and the VOC level in my home is above normal for Coatings, Paints, Adhesives, Sealants and the report says the air in my home is only “borderline acceptable”. I was taken to the emergency room for Toxic Inhalation Injury on 5/12/22 and my husband and I have been living in a hotel ever since. On 5/16/22 my primary care doctor diagnosed my with Dyspnea (shortness of breath). I am an extremely healthy individual and have never experienced anything like this in my lifetime. The fumes cause me nausea, headache, fatigue, respiratory distress, my corners of my mouth became raw and my glands began to swell. My lungs were sore for an extended period after removing myself from the fumes. My husband also experiences headache, nausea and breathing discomfort. The company Wingate will not remove the system and would not return my pleas for help for 17 days before they would come to my home. Then when they came, they smelled an odor coming from the unit and the vents but did not address it. They said it smelled like carpet and left. They have not figured out the problem and have not tried. I have had to hire an attorney. The fumes are worse when the temperature outside is warmer. The fumes seep directly from the air handler unit into the laundry room where it’s installed and into the joining hallway and comes through our vents into all area of our home even when the system is turned off. We paid $20,294.18 for the system with a 15 year parts and labor warranty. Wingate emailed us a 100% satisfaction guarantee and said it would refund our money only if we would sign a Settlement and Release agreement waiving our rights. This is in violation of Consumer Protection Laws. Please help us. Daikin is aware of the fumes since I filed a complaint with them well over a month ago, but they are not returning my calls. The system was installed on 2/23/22 and the fumes began about a month after the installation when the weather became warmer, and as temps outside rose, the fumes became unbearable, literally making me choke and I could not breathe the air in my home into my lungs and had to call the fire department who recommended the emergency room. As I said we have been living in a hotel ever since.
