The product, in the report: MasterCraft play sand (SKU 189-1108)
To: U.S. Consumer Product Safety Commission 4330 E - West Highway Bethesda, MD 20814
From: [REDACTED]
I am reporting a claim against Menards, INC and Midwest Manufacturing as follows:
Menards, INC 5101 Menards Dr. Eau Claire, WI 54703-9625
Midwest Manufacturing 5311 Kane Rd. Eau Claire, WI 54703-9624
I purchased 16 bags of MasterCraft play sand (SKU 189-1108) on April 16, 2021 from Menards in Kokomo, IN for our grandson’s play sandbox. On Mother’s Day (May 9, 2021), I noticed that my grandson’s hands and fingernails were stained black. I asked his mother ([REDACTED], who lives in [REDACTED]) what happened and she said it was from him playing in the sand. She had tried to scrub his hands, but the stains would not come off.
I checked the warning labels on the sand and it had items such as: wear protective gloves and protective clothing when using this product; do not eat, drink, or smoke while using this product; wash thoroughly after using this product; may cause cancer through chronic inhalation; do not breathe dust; dispose of contents and containers in accordance with all regulations.
Upon reading this, I alerted Menards and Midwest Manufacturing (makers of the play sand) in writing on May 13, 2021 about my concerns based on the stains on my grandson’s hands and the warnings on the package. With us being senior citizens who installed the sand and our 6 year old grandson who had been exposed to the sand sold as play sand, I asked Menards to remove the sand and refund our money. I felt that Menards and Midwest Mfg. put us and our grandson at great risk for using their product. After multiple efforts to rectify the situation, they refused to remove the sand and only issued a store voucher to us for the cost of the sand.
After getting no resolution from Menards or Midwest Mfg., my husband and I (both 69 years old) removed the sand at risk to ourselves wearing goggles, gloves, masks, and protective clothing. Consequently, this sand has been removed from the Menards in both Kokomo and Westfield, IN stores.
I feel like we should be compensated for our time and effort to protect our Autistic grandson and for his loss of not being able to use his sandbox ( or fort) during this spring to fall season. After reading their warnings, we do not know the long term effects to us or our grandson for handling this play sand. We feel that this sand should be removed from the market and we should be reimbursed for the endangerment to our health and our grandson’s health.
Please have Menards and/or Midwest Mfg. get with us to resolve this situation.
