The product, in the report: Backyard/Patio Swing
This caller is reporting a manufacturing patio swing purchased from Walmart in 1997.
A 2 year old child sustained injuries matching the design of the swing and narrow 5 to 3 inch opening in the front to rear, side leg support bar and back of the swing seat. The child was small enough to hang over the side support bars but unable to get out of the narrow side support bar and sloping heavy steel frame blocking her retreat from the entrapment.
As the child hung her body over the side support bar, the rear corner of the swing set struck her forehead and eyes multiple times causing subdural hematoma and possible brain injury.
In her efforts to stand up in order to free herself from her body entrapment, upper, mid and lower back came into contact with the curved down- sloping upper steel frame behind her, entrapping her body.
In those same moments she tried to stop the returning swing from hitting her, she grabbed under the swing bench seat frame, her wrist trapped between the 30 plus pound, 3 person bench seat and frame. Both to the front and rear of her wrist showed abrasions matching the swing design and sandy coated paint.
As she tried to hold the swing away from hitting her, she continued to try to back out, her head slid further in the frames narrowing side opening trapping her neck, face, eyes and ears leaving matching injuries to the design of the frame. Her neck was hyper flexed as she tried to pull her head out of the 3 to 5 inch side support bar opening.
The boyfriend feed the child by backing her head out of the entrapment as he pushed the swing away or off her head.
The child was not seen by a physician because once the child was freed and once calmed down seemed ok. Four days after the incident she began having seizures and was taken to [REDACTED] by her mother and mother’s boyfriend. The diagnosis was child abuse! However, her injuries are from this swing and this accident. The Keysheen Industries, Garden Winds, Royal Deluxe model RUS4113 is the model that hurt this child. I believe this was taken out of production modify into the model RUS 4116, which has only a 5 to 8 inch narrow opening. I believe both are dangerous and should be recalled.
I now have possession of both models for investigators to examine. In April of 2017, I was able to find the RUS116 from a local man who purchased it also in the same time period of 1997 and his swing seat to use for creating photos to demonstrate how she was injured. Signed. [REDACTED]
