The product, in the report: 30 inch bestway steel pro max above ground pool.

My 4 year old can climb up the pool due to the sewed in plastic piece that goes around the pool. That the legs go into. Its a 38 inch pool. If it had been my 2 year old this conversation would be different. Best way themselves sale this pool without a ladder. It seems climbing in was the intention of bestway its not safe at all.

The product, in the report: Bestway Residential above ground Pool Model batch# B15157/ n0006163

Caller stated that while she was in the the above ground pool the side broke. She stated that the entire side of the pool broke open next to the seam and dumped gallons of water out which could have caused serious injuries or fatality. She stated that she has minor bruises and neck pain, she was not seen by a physician. Caller stated that they have only used the pool for 2 seasons and it was gently used, the pool was still in box until 2019. The manufacturer was contacted and the incident reported and they informed her that she could filed a liability claim. Caller stated that she informed that she would like the company to send out someone to investigate the incident because of the defective product, however, they informed her that they did not have anyone to do that and the product was out of warranty.

Caller is concerned that this pool is a safety hazard and should be investigated.

Dear Consumer Product Safety Commission: I am sending pictures regarding this product. On July 7, 2021 I was contacted by Bestway manager, [REDACTED], whom stated he was calling me in regards to the warranty claim I submitted. (I had not submitted a warranty claim.) [REDACTED] stated the pool liner would be replaced if I sent them pictures of the failed product, Costco receipt, and model info off the pool. At first [REDACTED] was stating that the pool was set up incorrectly. He stated that the instructions are in the set up manual. Upon reviewing the set up manual, the pool was set up correctly and was level at the time of the failure. It does not seem Bestway is taking this product defect seriouysly. Which was my purpose of contacting them and inviting them to have the failure of the pool liner investigated to prevent potentially serious bodily injury or death.

I am sending the consent form back to you via USPS mail. I would like to sincerely thank you for your attention into this matter.
