No incident, no one hurt Made Apr 9, 2021, sent to the company Apr 13, 2021, published by CPSC Apr 27, 2021
The product, in the report: Genie Co. Commercial Line , Model OPGSXT5001B garage door opener, 1/2 HP, phase1, HZ60, pull 175 ftlbs/sec, AMPS 10/5/5, Volts 115/208/230, S/N 17030511740, UL FCC Part 15 FDDS/CNR 210 Model Genie OPGSXT5001B Standard Duty Commercial Operato
Date: April 5, 2021 Time: Approximately 18:15 MDT Location:\[REDACTED] Claimant\[REDACTED] was approaching the underbuilding parking garage entry door when the garage door opened and a Dark Gray/Silver [REDACTED] was exiting. [REDACTED] waved the [REDACTED] to exit so she could enter. [REDACTED] entered the garage while driving her[REDACTED] with a [REDACTED] and made it approximately one-third of the way into the garage when the door closed upon her car. This resulted in breaking the windshield, putting several deep, severe scratches along the roof and severely scratching the sun roof. All need to be repaired. The driver of the [REDACTED] may have pressed the button on their remote to close the door upon exiting as they normally do so this would be a habit. The garage door does not close properly. The required auto-reverse (16 CFR Part 1211) mechanism malfunctioned and continues to malfunction. [REDACTED] tested the functionality of the garage door on April 6, 2021 using the following described steps while opening and closing the garage door using both the direct wired switch for opening and closing and the Home Owner/Condo Owner Association (HOA) provided remote and found the following: 1. Utilizing the remote opener provided by the HOA and pressing the button to open the door, it opened. After remaining in the open position for a short period of time and while no other buttons or switches were activated or pressed the door will start to close on its own. I used my hands to see if I could stop the door from closing once it made contact with me as it should per 16 CFR Part 1211. The door stopped with minimal downward force and immediately opened again as it should. 2. Next test was to use the HOA provided remote opener to test and see if the auto reverse as required by 16 CFR 1211 functions properly when the remote is used to close the door rather than the timer as described above. This test replicates how the remotes are used by those who enter and exit the parking facility. The driver presses the opener button to open the door then after exiting they press the opener button again so the door will close. This test consisted of me pressing the opener button Once to open the door and waiting until the door was fully opened, I then pressed or activated the remote to close the door as if driving out or exiting. The door began to close as it had in the previous test but this time when I attempted to stop the door from closing by grasping it with my hands to hold it up or keep it from closing it continued to close with much downward force. The required auto-reverse did not and is not functioning as described and required by 16 CFR 1211. This is very dangerous as there are children that live in the building and vehicles coming and going with each user having a remote to open and or close the door.
This garage door is NOT SAFE TO OPERATE as the REQUIRED AUTO-REVERSE does not function as it should to prevent the type of accident that happened to [REDACTED] from occurring. The HOA would be facing a lawsuit had this door closed on one of the children living in this building.
It is clear that the garage door utilized with remote openers at the underground parking garage does not meet the requirements of the CPSIA of 1991 and 16 CFR Part 1211. Garage Door Operators/Gate Operators | CPSC.gov
The Consumer Product Safety Improvement Act of 1990 (Improvement Act) mandated that automatic residential garage door operators (GDOs) manufactured on or after January 1, 1991 conform to the entrapment protection requirements of the 1988 version of UL 325. On June 19, 1991, the Commission issued the garage door operator standard (16 CFR Part 1211). The Improvement Act provides that when UL makes changes to the entrapment protection provisions of UL 325, UL must notify the Commission of the proposed changes. Those changes must be incorporated into the Commission rule unless the Commission notifies UL within 30 days that the Commission has determined the revisions do not carry out the purposes of the Improvement Act. The mandatory safety rule has been changed two times since it was first issued in 1991.
Since 1991 garage doors have been required to come equipped with a mechanism that auto-reverses the door when it comes into contact with an object. Homeowners with automatic garage door openers that do not automatically reverse should repair or replace them with new openers which do reverse to prevent young children from being trapped and killed under closing garage doors. According to reports received by the U.S. Consumer Product Safety Commission (CPSC), approximately 60 children between the ages of 2 and 14 have been trapped and killed under automatic garage doors since March 1982. This is approximately 4 such deaths per year. Other children have suffered brain damage or serious injuries when the closing door contacted them, and failed to stop and reverse its direction.
[REDACTED] was advised by\[REDACTED] via text April 6, 2021 at approximately 7:45 A.M. that [REDACTED] should call her and the HOA would file a claim on her behalf. [REDACTED] made the call to [REDACTED] and later discovered that [REDACTED] was listening in on the call unannounced to [REDACTED]. [REDACTED] then told [REDACTED] that the HOA or Condo Association would not be filing a claim with [REDACTED] and she could if she wanted to. [REDACTED] policy number is [REDACTED].
Preliminary Estimate to Repair [REDACTED] Estimate provided by Mountain States Collision Repair, Inc. [REDACTED], [REDACTED] Replace windshield Repair and refinish rood Replace roof glass panel Total $3,146.63
[REDACTED] performed test 2 above while placing a cardboard box under the door to see if the auto-reverse will function as required by law or not. This test was videoed on April 7, 2021 at approximately 9:40 MDT, and will be emailed along with this letter to [REDACTED] claims at [REDACTED]
