The product, in the report: laminate wood flooring

Following Hurricanes DEBBY, Helene and Milton, my home experienced severe flooding and prolonged water intrusion. The home remained closed with limited ventilation for an extended period. There was high humidity, standing moisture, and extensive water damage. During this time, candles were also used inside the home because of storm-related conditions. After the flooding, indoor air quality testing detected elevated levels of multiple contaminants, including formaldehyde, which measured approximately 0.9. The testing also showed elevated air quality concerns affecting the indoor environment. As the home has remained vacant and dried out over time, humidity has decreased and more recent testing indicates that air quality has improved. During and after my exposure to the indoor environment, I developed serious health problems. These included ^^^seizures, neurological symptoms, worsening breathing difficulties, and recurring lung infections that have progressed to chronic pneumonia. I have also experienced cognitive impairment and have been diagnosed with brain injury. Because of these health conditions, I have been unable to safely live in the home, and the property has been abandoned.

I am submitting this report because I am concerned that prolonged exposure to contaminants inside a flood-damaged home, combined with poor ventilation and elevated indoor air pollutants, may have contributed to my severe health problems. I believe this information may help identify potential safety risks for other consumers living in flood-damaged homes after natural disasters.

I have documentation of the flood damage, indoor air quality testing results, medical treatment, and the condition of the home.

The product, in the report: Stranded Bamboo Flooring

We built on a 16 x 16 room to our home in 2014. We purchased stranded bamboo flooring from Lumber Liquidators on 4/26/2014 to place on this new floor. Ever since then both my husband and myself have been sick. We have lived in our home for 25 yrs with 0 health problems. Since the flooring we both have had a lot of respiratory problem such as: sore throat, shortness of breath , severe coughing, continuous phlegm. It is so bad that at this point we have to go to the doctor about every three to four months with the same symptoms. We have no insurance and we have to pay for all the medical bills out of pocket plus my husband had lost massive day of work. This flooring came from China (as stated on the box we still have). From research we have learned that all China imported flooring has extremely high levels of Formaldehyde in the glue that holds this wood together. These levels are a lot higher than the levels that the EPA in the U.S. allow. I have now been diagnosed with Asthma and my concerns are cancer next. Both me and my husband were healthy until this.

Below is an email correspondence I had with Lumber Liquidators; the letter details our experience of my son’s diagnosis with acute myeloid leukemia, a cancer that is associated with formaldehyde exposure, which I believe is the result of the flooring that we had installed in his room when he was 2 years old. I have also included the response from Lumber Liquidators.

Ultimately I had the flooring testing done on my own, and the tests reveal there are high levels in the flooring material as well as elevated levels of formaldehyde off gassing. I am now getting quote from a contractor to remove and replace the flooring.

I had a piece of the floor material tested, which it revealed levels of 1,100 mg/kg(PPM) of formaldehyde. I also had two air tests performed, one revealed 55ngL(44PPB), the second 54ngL(43PPB)

All test results are included in the attached documents.

From: [REDACTED] <> Subject: Flooring issue

    June 8, 2016

[REDACTED], Chairman Lumber Liquidators, Inc 3000 John Deere Road Toano, VA 23168

    Dear [REDACTED],

I am writing with serious concerns about the flooring that we purchased from Lumber Liquidators. It has become clear to me that it is unfit for human habitation and I would like compensation for the cost of removal, a replacement of my choice including a replacement subfloor heating system if necessary, as well as for the cost of the testing I have already conducted and any needed in the future. Although the flooring we installed is bamboo and not included in the study published by the CDC in early 2016, it prompted me to research and ultimately to initiate testing that has confirmed that there continues to be unsafe levels of formaldehyde in my son’s room. This is especially concerning because the report indicates that there is a connection to high levels of formaldehyde exposure and myeloid leukemia.

In 2005, we purchased and installed Lumber Liquidator Morningstar Bamboo Flooring along with approved subfloor heating in my then 2 year old son’s bedroom. In 2013, my son at age 9 became extremely ill and was diagnosed and hospitalized with acute myeloid leukemia, which is the exact type of leukemia that is associated with formaldehyde exposure. After reading everything I could find on the issue, I am convinced his leukemia was caused by the flooring. Thankfully, he survived the treatment and is doing well at this point.

In the attached folder you will find all relevant information that I have accumulated up to this point. I had a piece of the floor tested from wood that we had remaining from the installation; test results show high levels of formaldehyde in the material. Subsequently, I had the air in my son’s room tested two times, once comparing it to our living room, a second time comparing it to the outside air. Both tests taken from my son’s room are consistent and reveal elevated levels of formaldehyde. I am extremely disturbed that after 11 years, the flooring is still off gassing at rates that could cause health issues. I am even more upset that my son, who has already experienced such an extreme health crisis continues to be exposed, as am I and my other son.

Upon reading the CDC report in February, I immediately removed my son from his room, and he has been sleeping on the couch since that time. This has been a huge hardship in itself. The bigger picture is that we have had to experience the nightmare of his treatment, and the fears of what the future holds for him. Because of the type of chemotherapy he received, he has a greater risk of other cancers, his heart health has been jeopardized and he has to go for heart screening tests annually for the rest of his life, and there is a chance he could have fertility problems. Those are the more major long term consequences that he has to negotiate and monitor for the rest of his life.

In addition to the extreme emotional and spiritual toll on my entire family resulting from my son’s hospitalization in 2013, it has been a major setback to me financially. In 2013, I was just getting back on my feet after having gone through an incredibly difficult divorce. In January of that same year, I had started a small gardening business. When my son went into the hospital, I had to let go of the clients I had acquired, and was unable to work for almost an entire year. As a result, my business was drastically affected. This is in addition to all the expenses involved in having to deal with an extremely expensive medical crisis.

I have tried upon several occasions to contact Lumber Liquidators to gather more information about our specific flooring, but no one was able or willing to help me. I emailed you once, but got a rote response email referring me to the website, which really does not yield much specific information. I had one customer service person claim that my flooring was not made in China, even after I told her I had packaging that is clearly marked Made in China. I also tried to acquire one of the air test kits Lumber Liquidators is offering to customers, but because this flooring is not one of the ones involved with the CDC report, nor is it part of any class actions suits, I was denied a test. Considering all the information that has come to light in the past several years, it is reasonable to suspect that Lumber Liquidators as a company is aware of the defects with their flooring, but has not taken any steps to acknowledge or remedy the issue and has failed to warn me as a consumer.

As of Sept 2015, my employment situation has finally stabilized, but I have no funds to rectify the problems that have occurred because of the Lumber Liquidator flooring and am looking to your company to take financial responsibility for making my son’s room safe. As a retailer/wholesaler, I believe Lumber Liquidator should be held liable for the imported defective products that they manufacture and promote.

I look forward to hearing from you soon so that we can start taking steps to bring this to a resolution.

    Sincerely,

    [REDACTED]

    Dear Mr. [REDACTED],

Hello and thank you for contacting us.

Our bamboo floors are an entirely different product. They are made differently, and with different materials. While these products are not regulated by CARB or any other emissions standard, Lumber Liquidators has established strict formaldehyde emission standards for its solid bamboo products, and these products offer extremely low formaldehyde emissions. In addition, Lumber Liquidators regularly tests these products to monitor conformance to these specifications. Solid bamboo products were not the subject of recent reports, and free indoor air quality testing is not currently being offered to solid bamboo customers. There’s no need to test a solid bamboo floor.

Please feel free to contact us if you have any additional questions.

    Sincerely,

[REDACTED] Office of [REDACTED], Founder Lumber Liquidators, Inc 3000 John Deere Road Toano, VA 23168

The flooring was installed in the kitchen & 3 bedrooms over a period of 3 years. All rooms are on the same level of the home. A manufacturer authorized representative installed the flooring in three of the rooms and a private contractor did one of the other rooms.

The consumer experienced adverse health symptoms after the flooring was installed. The consumer did not identify exactly when the symptoms started the symptoms included shortness of breath, wheezing, continuous tearing, coughing, headaches, extreme itching and loss of hair. The odor in the home has been so extensive that it is affecting the consumer’s voice. Callers sometimes think that the consumer voice sounds raspy over the phone. The consumer now wears wigs due to loss of hair. She also experienced Pneumonitis (a lot of mucus in her lungs). The symptoms improve when she leaves the home and in particular, the tearing and shortness of breath. Other symptoms have become chronic.

The consumer has been treated by her primary doctor and was referred to a pulmonary specialist. The pulmonary specialist will provide results after further tests, but he is unsure if this has caused or contributed to asthma.

The consumer contacted the firm in late January 2016. The consumer asked for several testing kits but was only given one. She wanted several kits since the flooring was purchased over three years.

When the consumer went to the retailer, they told her that the test on the flooring was done by a 3rd party lab.

Any visitors to the consumers home were in and out of the home, so she is not aware of any symptoms with visitors. However her symptoms are worse when she is in a room with the flooring. She estimates that the flooring take up 50% to 75% of her home.

Consumer became aware of the flooring issue after seeing an article in her local newspaper and a news story on 60 minutes.

The consumer may add additional information upon receipt of this report.

The consumer indicates her invoice displays the following information:

The consumer indicates that she had her laminate flooring installed on approximately 03/2013 in her home kitchen and hallway. The consumer states that approximately nine months to a year after installation, her asthma symptoms became worse, and she also began getting headaches, which she had stopped getting almost two decades ago.

The consumer states that although she does not spend a lot of time in her kitchen, he sister does. The consumer indicates that her sister’s chronic obstructive pulmonary disease (COPD) has 1 headaches gotten a lot worse after their laminate flooring was installed in their home as well.

The consumer contacted the manufacturer after she saw the 60 Minutes report against them. She was informed that her flooring was in the list they had produced of those that were shipped from China. The manufacturer informed her that they would send out an air quality testing kit from a laboratory of their choosing and that they would mail her the results. They informed the consumer that they would not recognize another laboratory result.

Approximately two to three months later, the consumer received a report from Environmental Diagnostic Laboratory (EDLab) indicating that formaldehyde levels in her home fell within normal standards - with readings of 0.043 ppm.

The consumer visited the retailer to see if she could receive a refund or a replacement for the flooring but was informed that they would not be able to approve her request.

Though uncertain, the consumer believes her and her sister’s worsened health may be caused by high levels of formaldehyde, despite the air quality testing result; the consumer is not confident of these results since it came from a laboratory chosen by the manufacturer themselves.

The product, in the report: 12 mm Laminate Flooring

The consumer indicates that she began having headaches she never had shortly after her flooring was installed, and her allergies have worsened.

She visited an allergist and was diagnosed with unexplained idiopathic anaphylaxis. The consumer indicates that she also had ocular migraines on 08/17/2014, to which she was referred to a neurologist. The neurologist ordered an MRI scan on 04/2015, which confirmed a pituitary tumor. After blood-work, it was determined that is was of non-hormonal origins. The consumer indicates that because the tumor is new and she works at a cancer facility, it is being kept under surveillance. In 04/2016, she is scheduled to have another MRI to confirm if the tumor is growing or not; if so, the consumer will be scheduled for surgery.

The consumer has been using an inhaler for the past year, prescribed by her allergist, as she began wheezing - something that never happened before. The consumer states that prior to the installation of the flooring, she never had headaches nor ocular migraines either and so is uncertain if the flooring may be the cause.

The consumer indicates that the laminate flooring was installed throughout her basement.

The consumer was diagnosed with idiopathic anaphylaxis. Her condition escalated for a period of time after floors were installed but has subsided at this time. She doesn’t spend much time in the basement.

The [REDACTED] inhaler was used more frequent last year but that has subsided too. She does not keep the fireplace too warm in the basement. She has it cooler in case there is release of formaldehyde.

The consumer called Lumber liquidators main office on March 1st 2016 & spoke with [REDACTED] @0915, she stated “we will not send another air quality testing kit & there is nothing we will do because your initial air quality kit came back normal”.

    Subject: Mold on LVT Underlay

In February of 2014 I completed the installation of LVT Underlay and vinyl planks. In June of 2015 I removed a few and found mold growing on the underlay in 5 months. The underlay is warranted to be mold resistant. It was installed throughout my home and the area I removed was in the middle of front room with no exposure to moisture.

I have made several attempts to remedy this at the corporate and local retail store. After submitting a four page claim with pictures and many calls I was denied because they said I removed the material. I only removed a small portion of the material which was communicated and pictured to their representatives. After several more phone calls I spoke to a manager who said I was denied since they couldn’t verify the moisture level in my home.

I have not had time to remove and re-install the vinyl planks and underlay.

Injury information: Head ache started in May of 2015. Considerable anxiety due to headaches, time involved to fix $2500 financial cost for damage vinyl planks when removed & labor costs.

On 05/29/15 the consumer sent the testing kit to Environmental Diagnostics Laboratory (EDLab), located at 4911 Creekside Drive, Suite C, Clearwater, FL 33760 as instructed by Lumber Liquidators.

The consumer has been calling Lumber Liquidators to request some assistance and information about how to proceed but the consumer has not been able to speak with anyone that can assist him. The consumer last called Lumber Liquidators on 07/13/15 and filed a report on the matter and the consumer was told that someone would get back to him but no one from Lumber Liquidators has reached out to him as of today 07/20/15.

The consumer is not sure whether the symptoms are from the high levels of formaldehyde in the laminate flooring but he is very concerned about their safety since he became aware of the test results.

The consumer began going to his physician about these symptoms sometime in February 2014 (approximately). On 02/05/15 the physician told the consumer that he believes the consumer has sarcoidosis but the physician could not confirm it until he conducts a biopsy.

The consumer states his fiancé has also experienced congestion, headaches, and nose bleeds and has visited a physician regarding these symptoms. The consumer’s fiancé has received antibiotics and taken over the counter medicine. The consumer states his son has experienced runny nose, coughing, sneezing and congestion. The firm’s rep told the consumer that the allegations aired on CBS 60 minutes are false. The consumer was told that he would receive a kit to test his homes indoor air quality. The consumer told the firm’s rep about the test results of the flooring but the rep told the consumer that the test was probably done incorrectly.
