The product, in the report: Item name: “Hyper Tough 20” Side Discharge Push Mower with Briggs and Stratton Engine.” The mower can be found on the Walmart website at the following link: https://www.walmart.com/ip/Hyper-Tough-20-Side-Discharge-Push-Mower-with-Briggs-and-Stratton-Engine/431067123. Item specifications include: 125cc Briggs and Stratton engine and 20” steel cutting deck with side discharge. Manufacturer part number MNA152701. The mower is red and black.
I sustained a significant injury, losing two toes, while operating the “Hyper Tough 20” Side Discharge Push Mower with Briggs and Stratton Engine.” Due to the defective design or defective parts of this mower, my foot is permanently disfigured.
I purchased the mower roughly one year ago, and had used the mower several times over the course of the past year without any issues. The incident occurred when I was operating the mower on July 11, 2020. I was using the mower in the typical fashion to mow my small, flat yard. As I was pushing the mower through a clump of grass or weeds, the mower’s handle suddenly collapsed away from me. As the mower folded forward, I was propelled forward onto my right foot, which became caught under the mower and mangled by the blades. The blades chopped off half of my big toe, and the entirety of my second toe. I fortunately had the mental and physical capacity to make it in to my house and call 911, as I was home alone at the time of the accident.
Because the paramedics were unable to locate my toes when they arrived, the surgeon was unable to reattach them. While the sutures on my foot are nearly healed, I can no longer walk without a strong limp. The injury has interfered with my ability to perform my job and my ability to carry out basic everyday functions including driving, dressing, running, and bathing. I also suffered a tremendous amount of trauma and emotional suffering as a result of the accident.
