Emergency room Made Oct 16, 2015, sent to the company Oct 26, 2015, published by CPSC Nov 17, 2015
The product, in the report: 95 GALLON 2-WHEEL ROLLOUT CART
STEPPED ON THE OPEN LID OF THE CART, CAUSING THE CART TO FALL AND PULL ME AGAINST THE RIDGE OF THE CART. HIT MY LEFT CHEEK BONE CAUSING A GASH THAT REQUIRED STITCHES.
(FULL EXPLANATION ATTACHED IN EMAIL SENT ON MARCH 27, 2015 TO THE PRESIDENT & CEO OF REHRIG PACIFIC, MANUFACTURER OF THIS CART)
Text of the consumer’s e-mail dated March 27, 2015 addressed to the officials of Rehrig Pacific:
I am writing this email to you in regards to the 95 gallon compost Yardy bin that is contracted to the city of Cedar Rapids through your company. On Saturday, March 21, 2015 at approximately 4:30pm I was raking my yard and depositing the debris into the Yardy. I was using a shovel as a scoop and a rake, clamping them together as we have a large yellow lab that I was also cleaning up after and I don’t like to touch any of it with my hands. The Yardy was on my left and as I turned to empty the contents of my clamped debris into the open Yardy my foot caught the lid. The momentum caused by the heavy lid allowing the Yardy to fall immediately pulled me forward . Off balanced now by the rolling bin, I fell sideways and turned my head. The opposite side of the bin hit my left cheek bone causing a gash. It all happened so fast! It was like stepping onto a skateboard. I immediately went to St. Lukes ER, located about 15 minutes from my house. I received 7 stitches, a very bruised and swollen left side of my face, and a very sore neck from the force of the impact. 6 days later, as I write this to you my face is still swollen and tender and my neck is still very sore. It is hard to turn my head to the left without considerable pain. I will also have a permanent scar on my left cheek. After explaining to the nurse what happened, she nodded knowingly and said,”Yes, we see a lot of these injuries.” What?!! I couldn’t imagine more than just one or two people being hurt. But then I remembered my sister in law also had broken her fingers while moving her Yardy (with the lid closed). Just on a whim, I Googled “Yardy Accidents in Cedar Rapids” and I found an article “Attack of the Yardys” featured in our local Gazette. Many people have been hurt. The article did not specify whether all accidents had happened when the lid was open and moving. It implied many did. My accident was not caused by me actively moving it. The low hanging (9” off the ground) is easy to catch your foot on, the lid also makes it top heavy and on the very same side are large wheels. The design makes absolutely no sense to me. I will no longer be using my Yardy while my children and their friends are playing in the backyard, as one of them may come to talk to me and innocently run into it or run into it with a bike tire. Now I know that is all it takes for that top heavy, tall, hard plastic on wheels to tip and cause a serious injury. I’m aware I am not the only one. I would like to know what are your plans to improve on this design.
I have attached a pictured of my injury before the stitches and after.

Emergency room Made Jul 10, 2012, sent to the company Jul 26, 2012, published by CPSC Aug 9, 2012
The product, in the report: A 2-wheel cart, although used in this incident for yard waste collection, is also used for garbage and recycling collection.
I recently learned of an injury that I would like added to the files regarding injuries incurred with 2-wheel rollout carts. [REDACTED], was injured with his cart, manufactured by Rehrig Pacific Company, Los Angeles, CA.
[REDACTED] stated that “it was probably my own dumb fault as I was trying to do too many things at once.” [REDACTED] went on to explain that he wasn’t sure as to how it happened but that he was both emptying grass clippings into the cart and attempting to move it, when he suddenly was pulled to the ground and thrown inside the cart (also reported by his wife, [REDACTED]). Apparently [REDACTED] head hit the blunt edge of the cart as he suffered a facial laceration across the forehead, for which he received 8 stitches at a hospital instant-care facility.

Emergency room Made Nov 8, 2011, sent to the company Nov 18, 2011, published by CPSC Dec 12, 2011
The product, in the report: Dark Green yard waste receptacle with 2 single-axled small wheels and hinged lid. The unit tapers; wider at the top than at the bottom, which creates a hign center of gravity and makes it more prone to tipping.
In 2003 my nose was broken while transferring my Yardy yard-waste cart to the street for curbside pick-up. I am uncertain exactly how it happened, but I was rolling it across a relatively flat area of the lawn, perhaps striking a partially exposed tree root or a grass divot. In any event the Yardy tipped and the edge of the lid struck me squarely across the nose, causing immediate heavy bleeding. We have subsequently moved and no longer reside at the location of the accident. To my knowledge the unit is still in use at the address where the accident occurred.
My wife took me to the Emergency Room where I was informed I had a ‘clean’ nose fracture and no setting of the bone would be required; they said it would heal on its own. I recall the X-ray Tech telling me, “You’re not the first one of these that I’ve seen!”
My nose healed, but I was later informed I now had a deviated septum. Progressively I found my right nostril closing when I slept on my left side, causing severely restricted airflow thru the right nostril. It got to the point where I went to an ENT specialist and he performed surgery to correct the deviated septum on 3/29/2011. It is now early Novemnber of 2011 and I have scheduled another appointment with the specialist, as the right nostril is again causing restricted airflow.
Prior to the Yardy incident, I never experienced breathing problems through my nose.
