The product, in the report: 6 shot, cake style firework sold under the name “Bottoms Up” with a trademarked “Boomer” logo on it. Identifying number on the UPC label is “8 052531 328834.” Above the UPC label is the serial number “BM132883.”
The consumer was at a Fourth of July celebration on July 4, 2013. As part of the holiday celebrations, a 6 shot, cake-style consumer firework was set off. The firework was set on a flat, level surface and lit by the consumer, at which point he backed away from the firework. The firework then misfired, firing a shot laterally from the packaging hitting the consumer in his face, rather than firing vertically up into the air. The impact fractured the consumer’s right orbital bone and he suffered permanent vision loss in his right eye. The firework name was “Bottoms Up” and contained a trademarked “Boomer” logo, which was registered by Jake’s Fireworks, Inc. The firework was manufactured in China and imported by Jake’s Fireworks, Inc.
