The product, in the report: Eastman Outdoor Wolverine 6070 Carbon Arrow manufactured in Korea
[REDACTED] is an experienced archer and a Coast Guard Petty Officer. He has been active in the sport of archery for 15 years.
In approximately 2010, [REDACTED] purchased six (6) Eastman Outdoor Wolverine 6070 carbon arrows from Walmart, located at 5741 Buffalo Road, Harborcreek, Pennsylvania 16421.
On Monday, October 8, 2012, [REDACTED] went to a friend’s home on [REDACTED] to shoot the arrows for target practice. He used a Diamond Stud bow by Bowtech that was purchased new in 2010 and that was in perfectly good working order.
[REDACTED] prepared to shoot at his target from a distance of approximately 30 to 50 yards. He had shot these particular Eastman carbon arrows before. Prior to firing any of the arrows, he performed a visual inspection and flex testing. After shooting 3 or 4 arrows, about 12 times total—the final distance at the time of the incident being 50 yards—the arrow unexpectedly shattered and exploded into his left hand and thumb.
[REDACTED] went to St. John Medical Center’s in Cleveland, Ohio, where they performed a debridement. He had to return to the hospital on October 10, 2012, for further surgical intervention. The medical records reflect that [REDACTED] underwent exploration of the stab wound of the left thumb with complicated excision of over 100 splintered foreign bodies, primary repair of the ligament of the joint of the left thumb, primary repair of the extensor & distal tendons of the left thumb, DIP joint arthrotomy, and removal of multiple splintered aero shaft foreign bodies of the left thumb. [REDACTED] was fitted with an appropriate protective dressing and immobilizing splint.
The arrow incident caused [REDACTED] to sustain significant personal injuries. Medical reports indicate that he suffered severe injury and damage, pain and suffering, and required surgery, treatment, rehabilitation, and has resulted in permanent injury and loss of use. [REDACTED]’s injury caused him to have trouble in his performance of daily personal activities and at work. Since the surgical intervention and completing home exercises and home therapy treatment, [REDACTED]’s injury has improved; however, he still experiences pain and discomfort in his left thumb and hand.
