No incident, no one hurt Made Apr 15, 2026, sent to the company Apr 24, 2026, published by CPSC May 8, 2026
The product, in the report: Container of Product Name: LidoPatch Topical Pain Relief Patch Product Type: OTC Drug (Topical Analgesic Patch) Manufacturer/Distributor: JAR Laboratories NDC: 1088252901
The subject product contains lidocaine 4%, a pharmacologically active anesthetic associated with serious pediatric toxicity risks, including seizures, cardiac arrhythmias, and death. Despite this risk profile, the product is distributed in single-use flexible pouches with tear notches, allowing immediate access without any child-resistant mechanism. This packaging is not consistent with special packaging requirements under the PPPA. III. REGULATORY FRAMEWORK Poison Prevention Packaging Act (15 U.S.C. Part 1472(a)) 16 CFR Part 1700.1(b)(4) Special packaging definition 16 CFR Part 1700.15 / Part 1700.20 Child-resistance performance standards The observed packaging design cannot reasonably satisfy these standards, as it allows direct, single-step access to contents. IV. PACKAGING DEFICIENCY Observed characteristics: Tear-notches enabling immediate manual opening Single-step access to drug contents No child-resistant primary or secondary barrier No requirement for tools or coordinated actions From a compliance standpoint, this is functionally equivalent to nonchild-resistant packaging. The product identified herein appears to materially deviate from these requirements, raising both consumer safety concerns and regulatory non-compliance issues.
