The product, in the report: lawn tractor

I represent [REDACTED], who was two years old when part of his foot was traumatically amputated by a lawn tractor blade. The incident occurred on August 20, 2011. The police report stemming from this incident is enclosed herewith.

The subject tractor was a Craftsman lawn tractor, model number 917.273634. [REDACTED] father had started the mower and left it unattended to charge the battery while he used a push mower. Although the tractor was idling without an operator, the motor blade engaged. [REDACTED] stepped onto the discharge chute, which was uncovered, and came into contact with the rotating blade, partially amputating his right foot.

The Craftsman tractor was equipped with an operator presence sensing switch designed to automatically stop the blade, drive train, and engine if the driver’s seat was unoccupied. On the date of the subject incident, the safety switch malfunctioned, failing to shut down the mower and disable the blade and resulting in [REDACTED] injuries and damages. When the Yakima County sheriff s office responded to the scene, the riding mower continued to run with the blades engaged with or without weight on the seat and even with the seat lifted. Our office is currently investigating a potential product design and/or manufacturing defect which caused this incident to occur.

Because of the severity of the injury and the potential for this product defect to exist in other models, we urge your agency to investigate. My clients are willing to make the subject tractor available for your inspection. Please contact me office to arrange for such an inspection.

Thank you for your attention to this matter.
