What these words mean2
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

  • Plan of care (42 CFR 418.56(b))

    The inspectors’ words, 454 words

“Based on record review and interview, the hospice failed to ensure that all hospice care and services furnished to patients and their families followed an individualized written POC established by the hospice IDG in that 1 of 7 patients reviewed (#5) did not receive MSW and SC services as ordered in the POCs. This failed practice may result in severe negative outcome to the patients due to the patients not receiving adequate care to comfort and symptoms management. Findings include: Patient #5 Review of patient #5s CR showed SOC on 1/25/23, and benefit period 11/21/23 – 1/29/24 revealed IDG assessments/POCs dated 12/13/23, 12/27/23 & 1/10/24 revealed terminal diagnosis Senile Degeneration of the brain. Frequency of visits ordered included SN once/week, SC once/month and MSW once/month. Review of visit notes showed that SC and MSW were not provided for the benefit period. During interview with DON on 10/4/24 at 12:44pm he was asked why SC and MSW services were not provided for the patients. The DON stated that he did not know why MSW and SC were not provided for the patients. The DON added that frequencies of visits were discussed and determined during the IDG meetings. The DON stated that he did not review the visit notes to make sure the services were provided. During interview with Adm/SC on 10/4/24 at 2:45pm, she was asked why she did not provide SC for the above patients. Adm/SC stated that she provided SC for patient #5. Adm/SC explained that she visited the patient at least twice a month because the patients family and her (Adm) family were friends, and she provided SC to the patient when she visited. The Adm stated that her failure to document the visits was an oversight. Adm also stated that patient #1 declined SC because the patients family was very involved in their church and the church usually sent a deacon to the home to see the patient. The Adm was asked why the patients decline of SC was not documented and the service was continually reordered. Adm stated that she forgot to document the patients decline of SC. Adm further stated that after initial MSW assessment, MSW was usually provided for the patients as needed. Adm/MSW acknowledged that MSW should have been ordered as needed instead of once/month. Review of agencys policy titled “;Plan of Care”, dated 01/13/15, read in part: “;The hospice IDG will: Develop a POC and specify the hospice care and services necessary to meet the patient and family-specified needs identified in the comprehensive assessment as such needs relate to the terminal illness and related conditions. Provide the care and services offered by the hospice, and the group, in its entirety, will supervise the care and services.””

What the record doesn’t say

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.

None. Paid listings aren’t open yet. When they open, anything paid for will say “Paid by the hospice”, and paying will never change a finding, a rating or the order of results.
