What these words mean3
Star ratings
CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

    The inspectors’ words, 612 words

“Based on record review and interview the agency failed to ensure that Volunteers provided day to day administrative and /or direct patient care services in an amount at a minimum equals 5 percent of the total patient care hours of all paid hospice employees and contract staff for years 2 of 2 years reviewed (2024 and 2025) and currently for 2026. This failure placed patients at risk of not getting their volunteer needs met. RR of QAPI for ADS #2 and ADS #3 Action Plan revealed “... 1st quarter OAPI review was conducted on 5/23/24. Volunteer hours were 1.3% of patientcare hours, not meeting the 5% requirement.... 2nd quarter OAPI review was conducted on 10/7 /24. Volunteer hours were 1.6% of patientcare hours, not meeting the 5% requirement...3rd quarter 2024 OAPI review was conducted on 2/9/25. Volunteer hours were 1.7% ofpatient care hours, not meeting the 5% requirement...4th quarter 2024 OAPI review was conducted on 8/9/25. Volunteer hours were 1.4% ofpatient care hours, not meeting the 5% requirement...” RR Volunteer tool documentation completed by the Volunteer Coordinator dated 9-2-26 revealed between January 2025 and December 2025 the agency had a total of 26,276.25 total visit hours and a total of 111.12 Volunteer visit time with a total Volunteer percentage of 0.88%.RR form titled “ Hospice Volunteer Requirement Report” for year 2026 revealed the May 2026 total Volunteer time was 1.06%, June 2026 Volunteer time was 0.82%, July 2026 Volunteer time was 1.5%, and August 2026 Volunteer time was 1.35%.During an interview on 9-8-26 at 9:43 am the Administrator/Supervising Nurse stated that the agency has been trying to recruit but they have not been successful especially at the ADSs.During a telephone interview on 9-9-26 at 10 :00 am the family member of Patient #4 stated that he was told by agency staff approximately a week ago that the agency was having problems with getting volunteers. The family member further stated that they believed that Patient #4 would benefit from having a volunteer come by and talk with him because Patient #4 loves to talk to people.During an interview on 9-9-26 at 10:52 am the Volunteer Coordinator stated she had been in the position of Volunteer Coordinator for 3 years. The Volunteer Coordinator then stated she prior to the Agency being acquired in May 2026 by a new company she had been responsible for tracking the Volunteer hours for the Parent agency and the ADS with the help of the Office manager and Supervising Nurse. The Volunteer Coordinator then stated since being acquired the agency has been given much more resources to try and obtain volunteers. The Volunteer Coordinator then stated prior to the new company she would talk with the agency Consultant who would ask her questions about the volunteers and run the numbers to get the percentages and then the agency would do a Performance Improvement project on Volunteers. The Volunteer Coordinator stated that the agency grew faster than the number of volunteers they could get. The Volunteer Coordinator then stated when she noticed that the agency was not meeting the 5% threshold for volunteers she talked to the owners and leaders at the agency and sometime in 2025 the agency added a section to the letter that was sent to agency families to see if they would like to volunteer. She further stated, after getting some inquiries of interested people they never panned out due to other life obligations.RR Policy revised on 11-1-22 titled “Volunteer Roles and Responsibilities” revealed “The hospice maintains a volunteer staff sufficient to provide day to day administrative ordirect patient care to a minimum of 5% of total patient care hours for paid hospice employeesor contract staff.””

What the record doesn’t say

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
