What these words mean2
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

    The inspectors’ words, 297 words

“Based on record review and interview, the LMSW failed to be legally authorized in accordance with state laws in that the LMSW did not maintain active licensure as a Social Worker in the State of Texas. This failure had the potential of patients receiving social work services by a social worker who had not met the necessary standard of competency in maintaining active licensure in the State of Texas. Findings Included: Review of agencys contracts revealed a contract dated 08/16/2016 for LMSW. Review of the LMSW license revealed the license expired on 01/31/2021. Review of the Texas online social worker verification portal confirmed the LMSW license expired on 01/31/2021. 09/17/2024 at 11:35 a.m.- Surveyor conducted an interview with the Administrator. The personnel record and online license verification portal was reviewed. Administrator acknowledged LMSW license expired in 2021. Administrator stated, “;I already spoke to him about it. He said he didnt have $500 to renew the license so he let it go.” Surveyor asked if the agency has a new social worker. Administrator stated the agency does not have a social worker and has not had any other social workers since 2021. 09/17/2024 at 11:34 a.m.- Surveyor conducted a telephone interview with LMSW. Surveyor asked if LMSW had a valid license. LMSW stated, “;No. I let it go.” Surveyor asked when his licensed expired. LMSW stated he did not know the exact date, but it was in 2021. Surveyor asked why he did not renew his license. LMSW stated, “;The renewal fee used to be about $100. Now they jacked it up to $400-$500.” Surveyor asked if LMSW notified the Administrator that he could no longer provide SW services. LMSW stated, “;No.” LMSW also stated, “;I cant drive anyway. There is no way I could do any visits.””

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
