What these words mean2
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

  • Criminal background checks (42 CFR 418.114(d)(1))

    The inspectors’ words, 447 words

“Upon personnel record review, 4 of 11 (Personnel # 4, 5, 6, 9) did not contain evidence of a Criminal Background Check (CBC) having been obtained on all contracted individuals who have direct patient care and access to patient records, in accordance with Nevada State requirements. All of these contracted direct patient care files had evidence of a CBC having been conducted prior to the provision of patient care. However, they did not demonstrate evidence of the conduct of the required Nevada State CBC version as follows: Under Nevada Revised Statutes (NRS) 449.176 through NRS 449.188, people who have been convicted of certain crimes may not work at certain long term care facilities or agencies. The discussion here concerns the requirements of NRS 449.176 through NRS 449.188 only, and is intended as a guide only. The complete statute is available at http://leg.state.nv.us/NRS/NRS-449.html Under NRS 449, you must conduct a fingerprint-based criminal history background check on each employee and each independent contractor if you are the administrator of, or you are licensed to operate, any of the following: • Agency to provide personal care services in the home • Agency to provide nursing in the home • Facility for intermediate care • Facility for skilled nursing • Residential facility for groups • Homes for individual residential care These background checks must be conducted through the Central Repository for Nevada Records of Criminal History, an agency of the Nevada Department of Public Safety, Records and Technology Division. Even if you use another agency to conduct a preliminary criminal history check, you must conduct a background check by submitting fingerprints to the Central Repository, as required by the statute and summarized here. If your business is not one of the five types of entities listed above then you may choose to voluntarily submit fingerprints under NRS 179A.210 to obtain criminal history information with each employee’s consent, but you are not authorized to have the Department of Public Safety evaluate an individual’s criminal history under NRS 449. NRS 449.123 applies to every employee or independent contractor, including the administrator and the person licensed to operate the agency or facility, regardless of whether the individual provides direct patient care. You must conduct the background check in addition to any other fingerprint-based criminal history background check that the individual may have already undergone, such as to obtain a professional license, including a nursing license or a long term care administrator license. (See Special Notices below.) The statute does not apply to a volunteer. The statute does not apply to an individual that is not hired by you or your licensed entity but rather is hired directly by a resident at your licensed entity.”

    Rule L0795. Standard-level.

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.

From the hospice

The public record above comes first. Anything the hospice adds will appear here, below it, and say who wrote it.

Replies

None. Replies aren’t open yet. When they open, the hospice will be able to answer any finding for free, and the reply will show beside that finding, unedited and dated.

Paid listing

None. Paid listings aren’t open yet. When they open, anything paid for will say “Paid by the hospice”, and paying will never change a finding, a rating or the order of results.
