The short answer

What these words mean2
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

  • Recruiting and retaining (42 CFR 418.78(c))

    The inspectors’ words, 497 words

“Based on review of agency clinical records, agency documentation, interviews with agency personnel and review of agency policy, the hospice agency failed to document volunteer recruitment and retention efforts. The findings include: Review of Patient #4’s clinical record identified a hospice election date of 10/31/2025 with a diagnosis of protein-calorie malnutrition. The physician’s orders for the certification period of 10/31/2025 to 01/29/2026, identified the Patient required weekly nursing visits, home health aide visits five (5) times per week for assistance with activities of daily living, Social Work and Chaplin services once per month. The Patient was offered volunteer services upon admission, but declined at time of election. Review of a social work note dated 11/04/2025, identified “Patient #4 was open and accepting of the Social Worker visit and was grateful for the companionship in lieu of a volunteer “. Interview and review of social work note with the agency Social Worker (acting Volunteer Coordinator (SW-VC) on 2/11/26 at 8:50am identified he/she is also acting as the volunteer coordinator for the agency, and started in the role 8/2025. The SW-VC indicated the agency had 1 volunteer in the administrative office role, that worked weekly. The agency has not had any “patient facing” volunteers since the Social Worker started in the volunteer coordinator role. The SW-VC identified the agency has made attempts to recruit volunteers by putting fliers out at college campuses, and community centers without success. The SW-VC identified that once the agency has the new volunteer coordinator, they will work to obtain volunteers. The VC further identified that most patient/caregiver decline volunteer service, but if a patient /caregiver requests volunteer services the SW-VC, or Chaplin will perform the duties of a volunteer at this time. Review of the hospice agency’s volunteer program records from 06/01/2024 through 02/11/2026, identified the agency had one (1) volunteer who performed day-to-day administrative duties eight (8) hours a week, but had no direct patient care volunteers to perform patient visits from 06/01/2024 to date, with an agency census of sixty-eight (68) active hospice patients. Review of the QAPI meeting agendas/minutes dated 07/22/2025, 08/21/2025, 10/08/2025, 11/18/2025 and 01/07/2026 failed to identify documentation for any agency initiatives for volunteer recruitment and retention. Interview with the Regional Nurse Consultant (RNC) on 02/13/2026 at 11:00 AM, identified the agency’s Social Worker was currently acting as the Volunteer Coordinator, and if a patient or patient’s caregiver requested companion/volunteer services, the agency would utilize the services of the Chaplin or Social Worker, in the role of volunteer for the agency. The RNC further identified there was no documents available to support the agencies attempts, or ongoing efforts to recruit and retain agency volunteers. Review of the Volunteer Services policy identified the agency provided volunteer services under the direction of a volunteer coordinator. The volunteer coordinator would develop, implement and evaluate the volunteer services program on an ongoing basis but at least annually and would document ongoing efforts to recruit, train and retain volunteers of all ages and backgrounds.”

What the record doesn’t say

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
