What these words mean2
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Initial certification of terminal illness (42 CFR 418.102(b)(1))
The inspectors’ words, 310 words
“It is required that the hospice medical director or physician designee reviews the clinical information for each patient being evaluated for admission and provides written certification that it is anticipated that the patient’s life expectancy is six months or less if the illness runs its normal course. The physician considers the primary terminal condition, related diagnosis(es), if any, current subjective and objective medical findings, current medication and treatment orders, and information about the medical management of any of the patient’s conditions unrelated to the terminal illness when making this determination. This standard was not met as evidenced by clinical record review and interview. In 2 of 4 (50%) clinical records reviewed in which the hospice medical director wrote and signed the certification of terminal illness revealed the hospice did not ensure the physician’s review of the patient’s clinical information. Clinical Record 1: The physician’s certification for hospice benefit dated 8/2/2023-10/30/2023 did not contain evidence that the certifying physician composed a narrative explaining the clinical findings to support the patient’s terminal illness. The certifying physician’s written summary contains the verbatim narrative assessment written by the RN at the time of admission. Clinical Record 4: The physician’s certification for hospice benefit dated 8/4/2023-11/1/2023 did not contain evidence that the certifying physician composed a narrative explaining the clinical findings to support the patient’s terminal illness. The certifying physician’s written summary contains the verbatim narrative assessment written by the RN at the time of admission. An interview with the DPCS on 11/1/2023 confirmed this finding. She stated, “I know she’s been doing that.” She stated she told the medical director that she needed to write her own assessment. In 2 of 4 (50%) clinical records reviewed in which the hospice medical director wrote and signed the certification of terminal illness revealed the hospice did not ensure the physician’s review of the patient’s clinical information.”
