What these words mean3
- Star ratings
- CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Respect & Dignity
The inspectors’ words, 425 words
“PR-RESPECT & DIGNITY CFR(s): 494.70(a)(1) The patient has the right to- (1) Respect, dignity, and recognition of his or her individuality and personal needs, and sensitivity to his or her psychological needs and ability to cope with ESRD This Standard is not met as evidenced by: 15195 Based on record review and interview, the facility failed to take into consideration the physical condition of 1 (#10) of 10 patients reviewed, resulting in unmet patient needs. Findings include: Review of the facility complaint/grievance log and documentation revealed that patient #10 had to use the bathroom on 9/15/23 for bowel movements and staff could not help the patient in standing or wiping when she was done. Medical record review revealed that patient #10 had end stage renal disease and was admitted for outpatient dialysis treatments on 5/15/23, for four hour sessions, three times a week. On the 9/15/23 treatment sheet, the patient’s weight was documented to be 424.4 pounds. The patient’s comprehensive assessment documented wheel chair use and extensive assist. Interview with Charge Nurse A, on 12/5/23 at approximately 1030, revealed that patient #10 was over 400 pounds. Nurse A stated that she used a Hoyer Lift to take the patient out of the dialysis chair and transferred the patient to her wheel chair. The patient was wheeled to the bathroom. The patient then transferred herself from the wheel chair to the commode in the bathroom. When the patient was done using the toilet she could not stand or wipe herself. Nurse A could not lift or maneuver the patient to wipe her and other staff were busy with other patients. According to Nurse A, the patient was in the bathroom for 45 minutes to an hour with staff checking on her every ten minutes. Further interview with Nurse A revealed that their policy was that staff were not to lift patients due to potential staff or patient injury. Review of the facility policy titled “Safe Patient Handling, #4-08-19, revision date April 2023” documented, “...teammates are not required to manually lift patients that cannot bear any of their own weight, with the exception of life-threatening emergency.” The patient called her caretaker to help her in the bathroom prior to going home. The facility staff had not provided extensive assistance when required. On 12/5/23 at approximately 1130, interview with Facility Administrator J, revealed that the patient was advised to wear an incontinence pad and/or have her caretaker available during dialysis. The facility failed to identify and plan and/or provide the care needed to meet the patient’s physical needs.”
