The short answer
Record last released by Delaware Office of Child Care Licensing on Oct 29, 2026.
Each figure’s source sits beside it, in its section below.
What these words mean4
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
- Licence status
- Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
- Capacity
- The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

| Sep 29, 2026 | OCCL Standards Complaint: No Evidence to Substantiate | On June 18, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of inappropriate physical handling of Child #1 resulting in a fractured elbow, delayed parent notification, and inaccurate injury reporting. An investigation began on June 25, 2026. Clearance to complete the investigation was provided to OCCL on September 15, 2026. Based on the investigation, there is no evidence to substantiate the complaint for not using positive behavior management supports. Licensing Specialist (LS) #1 reviewed surveillance footage showing Staff #1 physically guiding Child #1 by holding their hand while Child #1 actively resisted by twisting their body away from Staff #1, resulting in a fracture to Child #1 s elbow. Staff #1 was placed on Administrative Leave after video footage was reviewed, until a final determination was made regarding the incident, as Tutor Time Human Resources stated physical redirection does not align with the company s hands-off redirection practices. There is no evidence to substantiate this complaint for failure to maintain accurate injury documentation. The initial injury report completed on June 4, 2026, by Staff #2 was made with the information Staff #2 had at the time of the injury. After District Manager #1 and Administrator #1 reviewed the surveillance footage, Administrator #1 completed a revised injury report on June 10, 2026, accurately documenting the cause of Child #1’s injury and provided it to the parents. There is no evidence to substantiate the allegation of delayed parent notification. Administrator #1 stated they began assessing Child #1 immediately after learning of the injury, attempted multiple telephone calls, sent an electronic message to the family, and directed Staff #3 to continue contacting the parents. Parent #2 was reached later that morning and Child #1 received prompt medical evaluation. Although approximately fifty minutes elapsed between the incident and successful paren t contact, documentation supports the administration initiated notification efforts immediately after recognizing Child #1 may have sustained a significant injury. |
| Jun 18, 2026 | OCCL Standards Complaint: Substantiated | On May 26, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding concerns of Child #1 not receiving prescribed medication as directed and medication administration was not being documented appropriately. The complaint also alleged Parent #1 requested Child #1’s Medication Administration Records (MARs) and the records could not initially be located. An investigation was conducted on May 29, 2026, with follow-up information obtained on June 3, 2026. Based on the investigation, the complaint is substantiated for failure to administer medication as directed. Licensing Specialist (LS) #1 reviewed Child #1’s asthma action plan provided by Nemours Children’s Health dated March 12, 2026, which directed administration of Child #1’s albuterol inhaler five to fifteen minutes prior to exercise or outdoor activity. Attendance records reviewed by LS #1 indicated Child #1 participated in outdoor play on multiple occasions during May 2026. Specifically, attendance records documented Child #1 attended outdoor play activities on May 13, May 15, and May 18, 2026; however, the MAR did not contain documentation indicating medication was administered prior to those outdoor activities as directed by the action plan. The complaint is also substantiated for failure to maintain complete and accurate medication administration documentation. LS #1 reviewed MAR documentation for March, April, and May 2026 and identified multiple deficiencies. The April 2026 OCCL MAR was not completed in its entirety. The May 2026 OCCL MAR did not contain medication instructions and lacked a parent or guardian signature. Additionally, no Tutor Time Prescription Medication Administration Consent Form was provided for May 2026. LS #1 also identified inconsistencies between attendance records and medication administration documentation. On May 8, 2026, the MAR documented medication administration at 10:30 a.m.; however, attendance records reflected Child #1 was signed out of care at 9:33 a.m. On May 6, 2026, medication administration was documented despite attendance records not indicating Child #1 participated in outdoor play. These discrepancies raise concerns regarding the accuracy and reliability of medication administration records maintained by the program. A secondary concern identified during the investigation involved attendance recordkeeping practices. LS #1’s review of attendance documentation identified numerous instances during May 2026 in which staff attendance records and child attendance records were not consistently maintained. This included 18 instances of staff not signing out of classrooms and multiple instances of children not being signed in/out of classrooms. |
| May 19, 2026 | OCCL Standards Complaint: No Evidence to Substantiate | On April 29, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of disrespectful communication with a parent. An investigation was conducted on May 6, 2026. Based on the investigation, including interviews with multiple staff members and review of documentation, there is no evidence to substantiate the allegation of disrespectful communication with Parent #1. Evidence obtained during the investigation reflects differing perspectives between the program and Parent #1 regarding recommendations for additional behavioral intervention services and implementation of a Positive Behavior Support Plan for Child #1. Documentation and staff interviews indicate the program discussed potential disenrollment if Child #1 s behaviors did not improve following implementation of the support plan. In regard to concerns about a requirement to fill out a consent to screen Child #1 using the Ages and Stages Questionnaire, parental permission to screen or a denial to screen is required by DELACARE Regulations for all enrolled children. |
| May 12, 2026 | OCCL Standards Complaint: No Evidence to Substantiate | On April 9, 2026, the Office of Child Care Licensing (OCCL) received a complaint alleging failure to provide an accident or injury report. There is no evidence to substantiate this allegation. Staff #1 and Staff #2 both indicated all injuries they are aware of are documented on injury reports and provided to families. LS #1 obtained eight incident reports involving Child #2 from various dates in April 2026, and four injury reports for children dated April 8, 2026. Documentation reflects behaviors by Child #2 including hitting, biting, scratching, and throwing objects at children and staff. Records show multiple children sustained injuries on April 8, 2026. Review of Child #2 s file demonstrates a consistent pattern of multiple daily incidents since enrollment in September 2025, with all incidents documented. |
| Apr 20, 2026 | OCCL Standards Complaint: Substantiated | On March 20, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding concerns of improper discipline and failure to follow procedures for notifying and reporting serious injuries. An investigation was conducted on March 25, 2026. Based on the investigation, the complaint is substantiated for failure to report and communicate a serious injury immediately. Documentation provided to LS #1 confirms receipt of an injury report signed by the family. However, the family did not receive an immediate phone call after the injury was addressed; instead, they were contacted at approximately 4:15 p.m. on the day of the incident to communicate the injury. Administrator #1 reported that Parent #1 questioned the time documented on the report, which was subsequently corrected. There is no evidence to substantiate the allegation of improper discipline. Administrator #1 reported the video footage existed for only one of the four incidents referenced in the complaint. Regional Coordinator (RC) #1 reviewed the available footage and did not identify improper discipline. Administrator #1 reported Staff #1 denied all allegations but acknowledged prior meetings addressing tone and interactions. Licensing Specialist (LS) #1 interviewed Staff #1 and Staff #2. Staff #1 denied all allegations of improper discipline. Staff #2 reported observations of Staff #1 using a tone perceived as inappropriate at times but also described Staff #1 as an effective teacher. |
| Mar 31, 2026 | OCCL Standards Complaint: Substantiated | On March 24, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding lack of heat and hot water, along with concerns related to failure to follow exclusionary illness policies. An investigation was conducted on March 24 and 25, 2026. Based on the investigation, the complaint is substantiated for lack of heat and hot water. Administrator #1 and Staff #1 confirmed a gas leak on March 20, 2026 required Delmarva Power to shut off gas service to the facility, resulting in loss of heat and hot water. Weather conditions on March 20 and March 23, 2026 allowed the building to maintain required temperature; however, hot water remained unavailable from March 20 through March 24, 2026. The complaint is also substantiated for an infant remaining in care with a fever. Administrator #1 confirmed to LS #1 an infant-aged child had a temperature of 104 F and was removed from the classroom to be cared for in the office. Administrator #1 stated care continued in the office while additional staff arrived to relieve the child s parent, who is also a staff member, so the child could be taken home. Documentation shows the child was signed out of the infant classroom at 9:30 am and remained in care until 1:20 pm. There is no evidence to substantiate the allegation related to requiring staff to report to work while ill with the flu. Administrator #1 provided documentation to LS #1 showing a staff member reported a flu diagnosis and called out of work. Additional records show the staff member was absent on March 17 and 18, 2026, following the call-out on the evening of March 16, 2026. When asked whether any staff member had been required to report to work after attempting to call out, Administrator #1 denied any such practice. Additional concerns identified during the investigation include failure to report a utility disruption to OCCL within 24 hours. Administrator #1 and Staff #1 confirmed gas service was shut off on Friday, March 20, 2026, resulting in loss of heat and hot water. Notification to OCCL should have occurred by Monday, March 23, 2026. Earlier notification would have allowed for technical assistance regarding hot water requirements and the process for submitting a variance request for use of portable heating units. |
| Feb 3, 2026 | OCCL Standards Complaint: Substantiated | On January 23, 2026, the Office of Child Care Licensing (OCCL) received a complaint alleging improper discipline involving a staff member sitting on a child to restrain the child during nap time. On January 29, 2026, a second complaint was received and associated with the same allegations of improper discipline. An investigation was conducted on January 28, 2026. Based on the investigation, the complaint is substantiated. Licensing Specialist (LS) #1 reviewed video footage of the incident and observed Staff #1 pulling Child #1 by the arm and legs and improperly restraining the child on their mat for approximately five minutes. Administrator #1 stated, as a result of the program s internal investigation and review of the video footage, Tutor Time Human Resources determined Staff #1 s actions were not in accordance with the program s positive behavior management policies and procedures, and Staff #1 s employment was terminated on January 22, 2026. |
| Aug 21, 2025 | OCCL Standards Complaint: Substantiated | On July 31, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding lack of supervision after a child exited the classroom through a classroom door leading to the playground while a teacher was changing diapers. An investigation was conducted on August 4, 2025. Based on the findings, this complaint is substantiated. Administrator #1 confirmed Child #1 left the classroom through the exit and was located by Staff #1, who saw the child s head pass the windows positioned next to the door. Staff #1 immediately brought the child back inside and reported the incident to the designated center management team, as Administrator #1 was on vacation that day. An additional concern identified during the investigation also identified was the program s failure to notify OCCL within 24 hours of an incident involving a missing child, as required by DELACARE regulations. LS #1 addressed this with Administrator #1 and provided technical assistance on the importance of promptly reporting regulatory violations to the assigned Licensing Specialist. |
| Jul 30, 2025 | OCCL Standards Complaint: No Evidence to Substantiate | On July 15, 2025, the Office of Child Care Licensing (OCCL) received a complaint alleging the program failed to follow child health exclusion procedures outlined in both the program and DELACARE handbooks. The complaint also raised concerns regarding inadequate supervision and improper staff-to-child ratios in the infant classroom. An investigation was conducted on July 23, 2025. Based on the findings of the investigation, there is no evidence to substantiate the claim concerning failure to follow child health exclusion practices. During an interview, Administrator #1 explained how the program manages illness. Children are excluded only when excludable symptoms are present. Administrator #1 emphasized the program s commitment to adhering to Tutor Time policies and DELACARE regulations. In cases where a child shows non-excludable symptoms, the program contacts families, informs them of the child s condition, and continues to monitor and document accordingly. Regarding the allegation of inadequate supervision and staffing ratios, the investigation found no evidence to support the claim. Administrator #1 described a practice of combining children during the last 90 minutes of the day, ensuring staff-to-child ratios remain developmentally appropriate based on the ages of the children in the group. LS #1 also interviewed Staff #1 and Staff #2 about procedures for staff bathroom breaks. Both staff members confirmed the use of a Code Orange system to request classroom coverage. They each stated they had never seen children left unsupervised or classrooms operating out of staff-to-child ratio. |
| Jul 30, 2025 | OCCL Standards Complaint: Substantiated | On July 18, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding a lack of supervision after a child was found in a closed classroom without their assigned teachers. An investigation was conducted on July 23, 2025. Based on the findings, the complaint is substantiated. Administrator #1, Staff #1, and Staff #2 all confirmed Child #1 left their classroom and entered a closed classroom. While Staff #2 was present in the room, they are a member of the housekeeping staff and do not hold a DEEDS Early Learning certificate. The teaching staff, who were responsible for supervising Child #1, were unaware the child had left the classroom until the child was returned. An additional concern identified during the investigation was the program s failure to notify the Office of Child Care Licensing (OCCL) within 24 hours of an incident involving a missing child, as required by regulation. LS #1 discussed this issue with Administrator #1 and provided technical assistance on the importance of reporting regulatory violations to the assigned Licensing Specialist in a timely manner. |
| Jun 10, 2025 | OCCL Standards Complaint: Substantiated | On May 19, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding failure to follow and complete a Medication Administration Record (MAR) for the use of Mylicon Gas Drops, failure to adhere to an infant feeding schedule, issues related to inadequate supervision, and lack of respectful communication in response to parent inquiries. An investigation was conducted on May 29 and May 30, 2025. Based on the findings, this complaint is substantiated for failure to properly follow and complete the MAR for administering Mylicon Gas Drops. Communication records from the Sprout About application indicate Administrator #1 informed Parent #1 of Staff #3 administering the gas drops prior to feeding, contrary to the instructions outlined in the MAR and the physician s directive, which specified post-feeding administration. Administrator #1 also acknowledged the MAR was not present in the classroom, preventing staff from referencing the required documentation to ensure correct administration procedures. There is no evidence to substantiate this complaint regarding failure to follow infant feeding schedules. Administrator #1 provided Licensing Specialist (LS) #1 with Child #1 s May Infant Feeding Schedule along with screenshots from the Tutor Time Sprout About application, which verify foods listed on the schedule were served to Child #1 as outlined. There is no evidence to substantiate this complaint regarding concerns of a lack of supervision. The design of the Infant One and Two classrooms supports continuous supervision, even during routine care activities conducted in the central care area. LS #1 directly observed a staff member changing a diaper while maintaining visual supervision of the classroom. District Manager #1 reviewed available video footage and reported no concerns related to insufficient supervision. There is no evidence to substantiate this complaint regarding a lack of respectful communication. Parent #1 submitted screenshots from the S prout About application showing staff responses to inquiries, confirming appropriate and timely communication occurred. |
| May 28, 2025 | OCCL Standards Complaint: Substantiated | On May 8, 2025, a complaint was reported to the Office of Child Care Licensing (OCCL) regarding their child being fed another child s bottle of breast milk. An investigation was conducted on May 16, 2025. Based on the findings of this investigation, this complaint is substantiated because Administrator #1 reported they were the staff member who fed Child #1 the wrong bottle. Administrator #1 saw the bottle cap with Child #1 s name on it, but did not verify Child #1 s name was on the bottle. When Staff #1 told Administrator #1 about Child #1 receiving the wrong bottle, Administrator #1 immediately took the bottle and confirmed it had Child #2 s name. Administrator #1 contacted both the families of Child #1 and Child #2. Administrator #1 also reviewed the policy of placing bottle caps in the children s bags once removed from a bottle. |
| May 5, 2025 | OCCL Standards Complaint: No Evidence to Substantiate | On April 11, 2025, a complaint was reported to the Office of Child Care Licensing (OCCL) regarding concerns about the building being 65 . An investigation was conducted on April 22, 2025. Based on the findings of this investigation, there is no evidence to substantiate this complaint. Administrator #1 stated the program was undergoing routine HVAC maintenance on April 11, 2025, the air temperature never fell below 65 , and the maintenance was completed by 3:00 pm the same day. The facility visitor log confirms the presence of the workers from an HVAC company on the day indicated in the initial complaint. |
| Apr 14, 2025 | OCCL Standards Complaint: Substantiated | On March 25, 2025, a complaint was reported to the Office of Child Care Licensing (OCCL) regarding concerns about the administration of breast milk to an infant it was not intended for. An investigation was conducted on April 1, 2025. Based on the findings of this investigation, the complaint is substantiated, as Administrator #1 confirmed the incident, provided corrective action documentation to Licensing Specialist (LS) #1, and communicated the situation to the families involved. As a result of the incident, Staff #1 was reassigned to another age group, and all staff members were re-trained on the program s infant feeding policies and procedures. |
| Jan 24, 2025 | OCCL Standards Complaint: Substantiated | On December 18, 2024, a complaint was called in to the Office of Child Care Licensing (OCCL) regarding allegations of lack of supervision and failure to provide an accident/injury report upon learning of an injury. An investigation was conducted on January 9, 2025. This complaint is substantiated for lack of supervision, as Administrator #1 stated video footage revealed staff members were either in the bathroom or near the counter area and not actively engaged with child interactions in the vicinity of the tent where the incident occurred. There is no evidence to substantiate this complaint for failure to provide an injury report at the time of the incident or within one business day. Parent #2 inquired with Administrator #1 on December 17, 2024, about not receiving an injury report for the incident which occurred on December 16, 2024. An injury report was subsequently provided on December 17, 2024, which is within one business day. Another report was issued on December 19, 2024, after sufficient details were obtained from the video footage. |
| Jun 17, 2024 | OCCL Standards Complaint: Substantiated | On May 22, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding failure to adhere to diaper-changing procedures and playground hazards. An investigation was conducted on June 4, 2024. This complaint is substantiated because Administrator Bridgitte Minks stated Child #1 did not have their pull-up changed while in care on May 20, 2024. This complaint is substantiated because there is peeling paint and canopy discoloration from mildew on the playground. The ground and plastic play structures did not have any observable hazards. |
| Mar 15, 2024 | OCCL Standards Complaint: No Evidence to Substantiate | The Office of Child Care Licensing (OCCL) received a complaint on February 7, 2024, regarding improper discipline. An investigation was conducted on February 19, 2024. There is no evidence to substantiate this complaint for improper discipline because all staff members interviewed stated they did not observe Staff #1 aggressively pulling or pushing Child #1 or any child in care. Documentation was received from September 20, 2023, regarding Staff #1 using an elevated tone with children, but this does not meet the level of concern for improper discipline. Video footage from Child #1 s classroom on the day of the alleged incident was not available because video footage is only saved for seven days. Three staff members and Administrator Brigitte Minks were interviewed and stated the cameras in the Preschool 1 classroom do not cover the library Cozy Corner area of the classroom. Documentation was provided during this investigation regarding the termination of care for Child #1 due to escalating behaviors. This action aligns with the facility s dismissal policy in their parent handbook. |
| Mar 11, 2024 | OCCL Standards Complaint: Substantiated | On October 18, 2023, the Office of Child Care Licensing (OCCL) received a call from Administrator Brigitte Minks self-reporting an incident that occurred at their center. This incident was also called into the Child Abuse and Neglect Report Line and was screened out by the Institutional Abuse Unit (IAU) but referred to OCCL for investigation. Video footage of this incident was reviewed by Administrator Minks, District Manager Samantha Young, Licensing Supervisor Laurie Bailey, and LS Brady via Microsoft TEAMS on October 24, 2023. This complaint is substantiated for improper discipline because Staff #1 was observed holding Child #1 by his arm and leaving a mark. Staff #1 was suspended immediately after Administrator Minks was made aware of the incident, and Staff #1 s employment was then terminated upon review of the video footage. LS Brady received a copy of the termination letter provided to Staff #1. |
| Feb 16, 2024 | OCCL Standards Complaint: Substantiated | The Office of Child Care Licensing (OCCL) received a complaint on January 30, 2024, regarding incorrect staff-to-child ratios in the three-year-old classroom. An investigation was conducted on February 2, 2024. This complaint is substantiated for incorrect staff-to-child ratio based on staff interviews and documentation received. Four staff members interviewed, including Administrator Brigitte Minks, stated they had incorrect staff-to-child ratio in the opening Preschool 1 classroom. Based on the attendance records viewed, there were three days when the staff-to-child ratio in the opening Preschool 1 classroom was incorrect. |

What the record doesn’t say
- Delaware doesn’t grade violations by severity, so read what was cited.
- Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
- Delaware publishes five years of reviews and complaints; this page shows the last three.
- Delaware doesn’t publish staffing levels or owners for individual providers.
- Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
