The product, in the report: Destiny Residential Elevator, which was manufactured by National Wheel-O-Vator Company, Inc.. Please note that National Wheel-O-Vator was subsequently acquired by ThyssenKrupp Access Corporation/ThyssenKrupp Access Manufacturing, LLC. Manufacturer: National Wheel-O-Vator, Inc. Model Name: Destiny Residential Elevator Model Number: DW25 Serial Number: 121692 Schematic No.: DW4C_R3 Date of Manufacture: September 28, 2007
The following is being provided on behalf of the family of the three year old child referenced below, who may be contacted through their legal representatives: [REDACTED].
On Christmas Eve of 2010, a three year old boy was on the main level of his family’s three story home. The family’s home was equipped with a Destiny Residential Elevator manufactured by National Wheel-O-Vator, which has since been acquired by ThyssenKrupp Access Corporation and/or ThyssenKrupp Manufacturing, LLC. The boy became entrapped between the hoistway door and elevator accordion car door on the second floor of the family’s home. The elevator was subsequently called from the third floor while the boy was entrapped between these doors. The boy was subsequently found by his mother crushed by the elevator. The jaws of life were used to extract the child from the elevator. Unfortunately he suffered an anoxic brain injury as a result of this accident. His brain injury is catastrophic and permanent and he now requires life care assistance for all of his activities of daily life.
Notably, this is not the first case of child entrapment between the hoistway door and elevator car door/gate. This issue has been known to the elevator industry since the 1930s. Many children have been seriously injured or killed in similar accidents. There are technologically and economically feasible designs that eliminate this hazard completely.
These elevators remain on the market today. There has been no effort to date to notify or warn current owners of Destiny Residential Elevators of the known hazard of child entrapment, which hazard can result in catastrophic injury or death. Earlier this year, ThyssenKrupp Access announced that it is ceasing its US operations at the end of 2012.
