What these words mean3
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
- Condition-level deficiency
- For hospices, home health agencies, hospitals and dialysis facilities, CMS writes deficiencies at two levels. Standard is the usual one; condition-level is the more serious, when a problem is serious enough that the provider doesn’t meet a whole condition of taking part in Medicare. Patient Rights: Care In Safe Setting
The inspectors’ words, 948 words
“PATIENT RIGHTS: CARE IN SAFE SETTING CFR(s): 482.13(c)(2) The patient has the right to receive care in a safe setting. This Standard is not met as evidenced by: 51070 Based on review of policy and procedure, training materials, observation, and interviews, it was determined the facility failed to ensure that patients received safe effective pulmonary care in that inconsistencies were observed during the practice of suctioning ventilated patients, staff did not follow manufacturers guidelines for the closed suction system device or facility procedure, and there was confusion as to which roles could perform closed suctioning on patients on the ventilator or with a tracheostomy collar (T-collar). The failed practice increased the likelihood of harm and/or failure to rescue patients experiencing a respiratory emergency. The failed practice had the likelihood of affecting all patients on a ventilator or a T-collar. Findings follow: A. A policy was requested which identified which roles could perform suction procedures on ventilated patients or those with a T-collar on 07/09/25 at 1:30 PM and again on 07/10/25 at 9:30 AM. None was provided. B. Review of training material titled “Cornerstone Hospital General Hospital Orientation”, no date, showed a picture of a closed suction catheter and stated, “suctioning is a shared task between nurses and respiratory therapy (RT)”. Additionally, a note at the bottom of the training slide showed that staff should seek help from RT if they need additional training or practice with suctioning skills. C. Evidence was requested on 07/09/25 at 1:30 PM and again on 07/10/25 at 9:30 AM which showed that staff members had been trained in respiratory care and suctioning techniques (i.e. open and closed) on ventilated patients or those with a T-collar, None was provided. D. During observations of respiratory procedures on 07/09/25 at 11:00 AM and again on 07/10/25 at 11:00 AM, Surveyor #1 observed different procedures for closed suctioning using the same closed suction system. E. During an interview with RT #1 on 07/09/25 at 11:15 AM, he stated “I push the suction catheter down until I hit the carina and pull back a little and start suctioning”. F. During an interview with RT #2 on 07/10/25 at 11:35 AM, he stated he “pushes the suction catheter down until he meets resistance and begins suctioning”. G. During an interview with Registered Nurse (RN) #2 on 07/10/25 at 12:45 PM, she stated that she “advances the closed suction system until she hits something and then pulls back, but I only suction if RT is busy”. H. During an interview with the Respiratory Therapy Manager on 07/09/25 at 10:00 AM, she confirmed the unit is staffed with two RTs each shift and may be busy with daily respiratory treatments or in an emergency leaving nursing staff to attend to the pulmonary needs of patients within their scope of practice. I. During an interview with the Director of Quality and the Chief Clinical Officer (CCO) on 07/10/25 at 1:30 PM, both stated that nursing staff do not perform closed suction on ventilated patients or those with a T-collar. The CCO confirmed the findings in A-I during the interview. 52740 Based on policy, observation, clinical record review, and interview, it was determined the facility failed to provide a safe environment free from defects, chemical contaminants, and infectious organisms. The failed practice did not prevent the spread of infection or ensure patients and staff were safe from harm. The failed practices had the likelihood of affecting all patients receiving care in the facility. A. Review of policy “Patient Safety Plan” (Review Date 05/2022) showed, “The organization wide patient safety program is designed to reduce unexpected occurrences, undesired outcomes, and hazardous conditions by utilizing a systematic, coordinated and continuous approach to the improvement of patient safety. “... All operational areas of the hospital are monitored for patient safety compliance by its staff continuously and are reported to the Environment of Care/ Patient Safety Committee.” B. Protocol “Clorox Total 360 Disinfection Protocol” showed, “Required Personal Protective Equipment (PPE): Eye protection, gloves, gown or long-sleeved covering, surgical mask or N95 respirator. Pre-use Checklist: Remove people, pets, food, and sensitive electronics from the area. Ensure proper ventilation. Post-Use Procedure: Ventilate the area if needed. Do not allow re-entry until surfaces are dry and safe.” Additionally, the Protocol “Clorox Pro Quick Start Guide” showed steps in utilizing the Clorox Total 360 system includes closing the area off to the public and placing a ‘Cleaning in Progress’ sign outside of room. C. During a tour on the facility on 07/09/2025 between 9:00 AM and 10:30 AM the following was observed. 1. A pill crusher located in the east medication room showed multicolored powdery residue. 2. The east nurse’s station had an alcove with a refrigerator marked “for patient use only” and showed melted food products in the freezer and “Lemon Glycerin Swabs” which should be stored at room temperature per manufactures insert. 3. An electrical panel in the east nurses station was unlocked and the door latch was broken. 4. The handrails on both sides the hall near the administration office had large cracks in the plastic leaving sharp loose edges. 5. The medication refrigerator in the west medication room did not have a locking mechanism allowing for unauthorized access to refrigerated medications. 6. A member of housekeeping was observed using the Clorox 360 disinfectant system in a patient room. The housekeeper did not don eyewear, gloves, or gown while spraying the room with aerosolized bleach particles. Additionally the room had not been closed off per manufacturers instruction to prevent chemical contamination to those walking past the room. D. During an interview with the Chief Clinical Officer on 07/09/25 at 12:30 PM, the findings in A-C were confirmed.”

What the record doesn’t say
- CMS doesn’t publish fines or other penalties for inpatient rehabilitation facilities or long-term care hospitals, so none are shown.
- Only complaints that led to a citation appear; complaints that didn’t aren’t published.
- Many of these facilities are accredited by a private organisation (The Joint Commission, DNV and others) whose routine inspections stand in for the state’s; those reports aren’t public, and QCOR holds only the state’s surveys: no inspection on record here doesn’t mean none took place.
- QCOR says its hospital inspection data are complete only through September 17, 2026, while it moves to a new system.
- CMS doesn’t publish staffing levels for these facilities.
