What these words mean2
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Sep 8, 2025: recertification inspection by the state1 deficiency
  • Hospice aide qualifications (42 CFR 418.76(a)(1))

    The inspectors’ words, 315 words

“Based on record review and interviews, the agency failed to assure that the Administrator does not perform hospice aide tasks on 1 of 5 active patients, without direct supervision from an RN until he received additional training to meet hospice aide qualifications. This failure could place the agency’s clients at risk of receiving inadequate care from agency personnel which are not qualified. The findings included: During an interview on 9/4/2025 at 9:30 a.m., with the FM of Patient #5, the FM stated that the Administrator assisted in personal care for Patient #5 by dressing and assisting in transfer of Patient #5. The FM stated that Patient #5 was not harmed while the Administrator was assisting with personal care. Record review of the Administrator’s personnel documentation revealed a date of hire of 4/1/2025. There was no documented evidence in the personnel record that the Administrator was certified as a hospice aide or had the qualifications and training of a hospice aide. During an interview on 9/5/2025 at 1:30 p.m., with the Administrator, the Administrator acknowledged responsibility in performing dressing and assisting in transfer of Patient #5 during “a couple of home visits “and was not qualified as a hospice aide. The Administrator also stated the importance of being certified as a hospice aide in the State to perform tasks of personal care on hospice patients. The Administrator also revealed, “sometimes it’s difficult to say no, and his caregiver was elderly so I thought I could assist.” Record review of an agency policy titled, “Reporting Changes,” dated 4/14/2023, read in part, “…agency employs individuals who are qualified by education, training, and experience to carry out all duties assigned to them and have valid credentials as required by Federal, State, and local regulations…Employees act only within the scope of his or her state license, or State certification, or registration. All personnel qualifications are kept current at all times…””

    Rule L0609. Standard-level.

What the record doesn’t say

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
