What these words mean3
Star ratings
CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

  • Review of the plan of care (42 CFR 418.56(d))

    The inspectors’ words, 696 words

“Based on record review and staff interviews, the hospice agency failed to ensure that the Interdisciplinary Group reviews and revises the plan of care to address changes in patient’s condition and needs as identified in the comprehensive assessment, in accordance with hospice policies and procedures. This was evident for one (1) of three (3) clinical record reviews (Patient #1). Failure to ensure that the Interdisciplinary Group reviews and revises the plan of care to address changes in patient’s condition and needs, as identified in the comprehensive assessment, has the potential for negative patient outcomes. The finding is: 1. Patient #1 has a start of care date of 03/19/2024, Discharge Date of 03/14/2025 with diagnosis of Senile Degeneration of Brain documented in the “Physician’s Orders/Plan of Care” for the Benefit Period 03/14/2025 to 05/12/2025. The “Physician’s Orders/Plan(s) of Care” for the Benefit Periods 11/14/2024 to 01/12/2025, 01/13/2025 to 03/13/2025 document that the patient is to receive Skilled Nurse visits one to three times a week. The Registered Nurse/Skilled Nurse comprehensive visit note dated 12/03/2024 documents the patient has “a new wound” on the left upper back. The Registered Nurse documents the following wound assessment: wound type lesion, wound tissue beefy red, measurement 2 cm (centimeters) x 1cm, surrounding skin intact, no drainage. The Registered Nurse documents: “wound care instructions were given during visit.” The subsequent weekly Registered Nurse/Skilled Nurse comprehensive visit notes dated 12/10/2024, 12/17/2024, 12/24/2024 (Recertification), 12/31/2024, 01/07/2025, 01/14/2025, 01/21/2025, 01/31/2025, 02/04/2025, 02/11/2025, /03/04/2025 (Recertification) and 03/11/2025 document: weekly wound assessment of left upper back lesion, “not healing;” and “Dressing changed this visit: Yes, per order, see Care Plan.” The “RNCM (Registered Nurse Case Manager) Visit/Recert Visit” Clinical Update/ Progress notes dated and sent to the Hospice Physician on 12/24/2024 and 03/04/2025 document: the visit summary and Hospice Physician “made a telehealth visit during this time.” The MD (Medical Doctor) Face-to-Face Encounter” telehealth visits dated 12/24/2024 and 03/04/2025 lack documentation of the left upper back lesion. The clinical record lacks documentation of wound care orders/instructions to address the left upper back lesion. The “Wound Care Assessment” Policy (Approved 06/21/2024) documents: The nursing staff “documents an individualized plan for each patient with a wound based on the physician’s orders, patient’s needs, and plan of care goals” “wounds are discussed in the Interdisciplinary Team (IDT) meeting;” “A wound care specialist is available to Hospice for consultation as determined by the IDT (Interdisciplinary Team). A WOCN wound care consult is initiated by the RNCM (Registered Nurse Case Manager).” The “IDT (Interdisciplinary Team) Plan of Care” Policy (Approved 11/23/2023) documents: “The Plan of Care is routinely reviewed by the IDT (Interdisciplinary Team) as frequently as the patient’s condition requires, but no less frequently than every 15 days.” The “IDT (Interdisciplinary Team) Assessment(s)” dated 12/05/2024, 12/19/2024, 01/02/2025, 01/16/2025, 01/30/2025. 02/13/2025, 02/27/2025, 03/13/2025 documents in the Plan of Care Changes section: “Are there any changes to the patient’s condition or Plan of Care (in any clinical area) since the last IDT (Interdisciplinary Team):” “No change to the patient’s condition. Patient is managed with the current Plan of Care.” The clinical record lacks documented evidence of Interdisciplinary Team discussing, reviewing and revising the plan of care, in accordance with hospice policies and procedures, to address the new wound identified in the comprehensive assessment on 12/03/2024. On 05/20/2025 at 3:55pm, the Registered Nurse Case Manager was interviewed and stated: the wound care order was “cleanse with Normal Saline, pat dry, and apply foam dressing;” “I don’t see that (order) there” in the record; the physician was made aware in December; I told physician “what (wound care) I did;” the wound was discussed in IDT(Interdisciplinary Team); it’s “not documented,” “I didn’t see any changes in the wound.” On 05/20/2025 at 3:55pm, the Hospice Physician was interviewed and stated: “I told the nurse to monitor” the lesion; I saw pictures of the lesion in March; “typically, I make a change in an order” for wound treatment; “no treatment” was ordered. On 05/21/2025 at 11:20am, the Chief Medical Offer/Medical Director, the Senior Vice President/Administrator/Director of Patient Services, the Chief Operating Officer, and the Assistant Vice President were interviewed about the finding and no additional evidence was provided.”

  • Coordination of services (42 CFR 418.56(e)(2))

    The inspectors’ words, 638 words

“Based on record review and staff interviews, the hospice failed to ensure a system of communication and integration was implemented according to the hospice policies and procedures and that care and services are provided in accordance with a written plan of care to address the patient wound care needs. This was evidence in one (1) of three (3) clinical record reviews (Patient #1). Failure to ensure a system of communication and integration and the provision of care and services in accordance with a plan of care has the potential for negative patient outcomes. The Registered Nurse documents the following wound assessment: “wound type lesion, wound tissue beefy red, measurement 2 cm (centimeters) x 1cm, surrounding skin intact, no drainage”. The Registered Nurse documents: “wound care instructions were given during visit.” The subsequent weekly Registered Nurse/Skilled Nurse comprehensive visit notes dated 12/10/2024, 12/17/2024, 12/24/2024 (Recertification), 12/31/2024, 01/07/2025, 01/14/2025, 01/21/2025, 01/31/2025, 02/04/2025, 02/11/2025, /03/04/2025 (Recertification) and 03/11/2025 document: “weekly wound assessment of left upper back lesion”, “not healing;” and “Dressing changed this visit: Yes, per order, see Care Plan.” The “IDT (Interdisciplinary Team) Plan of Care” Policy (Approved 11/23/2023) documents: “Ongoing communication among IDT (Interdisciplinary Team) members is essential for quality care. Documentation of all communication pertinent to the plan of care will be reflected in the clinical record.” The “Wound Care Assessment” Policy (Approved 06/21/2024) documents: “Hospice Physician or designee is notified of newly developed wounds.” The clinical record lacks documented evidence of the Registered Nurse Case Manager notifying the Hospice Physician of the new wound on the left upper back and obtaining wound care instructions/orders to revise the plan of care. There is no documented evidence of communication between the Registered Nurse and the Hospice Physician regarding wound care instructions. On 05/20/2025 at 3:55pm, the Registered Nurse Case Manager was interviewed and stated: the physician was made aware in December; I told the physician “what (wound care) I did;” the wound care was “cleanse with Normal Saline, pat dry, and apply foam dressing;” “I didn’t see any changes in the wound.” On 05/20/2025 at 3:55pm, the Hospice Physician was interviewed and stated: “I told the nurse to monitor” and “no treatment” was ordered for the lesion. On 05/21/2025 at 11:20am, the Chief Medical Offer/Medical Director, the Senior Vice President/Administrator/Director of Patient Services, the Chief Operating Officer, and the Assistant Vice President were interviewed regarding the findings and the Chief Operating Officer present an email explanation from the Hospice Physician. The email dated 05/21/2025 documents: “The skin finding on (Patient #1’s) back was a lesion in my medical judgement, not a wound that that required active treatment.” “I determined that observation of the lesion was the appropriate management, and my instructions to the RNCM (Registered Nurse Case Manager) were to monitor the lesion for changes and instruct family to do the same. No treatment orders were required.” “The physician’s verbal communication with the nursing staff, including instructions regarding routine patient care and standard orders, are documented by the nurse.”The clinical record lacks documentation of communication from the Hospice Physician to the RNCM (Registered Nurse Case Manager) with instructions to monitor the lesion and that no treatment orders were required, in accordance with the IDT Plan of care Policy to document all communication pertinent to the plan of care.”

What the record doesn’t say

  • CMS doesn’t publish fines or other penalties for hospices, so none are shown.
  • Only complaints that led to a citation appear; complaints that didn’t aren’t published.
  • CMS ended its Special Focus Program for hospices with serious problems on Feb 14, 2025, so no hospice is marked as one.
  • Hospice quality measures have a gap from October 2025: CMS replaced its patient assessment then, and public results from the new one (HOPE) are expected around November 2027.
