What these words mean4
- Star ratings
- CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
- Condition-level deficiency
- For hospices, home health agencies, hospitals and dialysis facilities, CMS writes deficiencies at two levels. Standard is the usual one; condition-level is the more serious, when a problem is serious enough that the provider doesn’t meet a whole condition of taking part in Medicare. Source: CMS, State Operations Manual.

“PE-SAFE/FUNCTIONAL/COMFORTABLE ENVIRONMENT CFR(s): 494.60 The dialysis facility must be designed, constructed, equipped, and maintained to provide dialysis patients, staff, and the public a safe, functional, and comfortable treatment environment. This Standard is not met as evidenced by: 28421 Based on observation and interview, it was determined that the facility failed to ensure the safety and comfort of its staff and patients in the facility. Findings were: Facility policy entitled “Cleaning and Disinfection” stated its purpose as “to provide guidelines to maintain a clean, safe, and aesthetically pleasant environment for patients, staff, and visitors. To prevent the spread of infectious disease in accordance with appropriate regulations.” The policy continued, “Noncritical equipment surfaces shall be cleaned with a low-level disinfectant. High touch surfaces shall be cleaned and disinfected on a more frequent basis than minimally touched housekeeping surfaces.” Tour of the patient treatment area on 8/28/24 revealed several areas (8X10 feet) of dried bicarbonate on the floor, surrounding patient chairs and dialysis machines. Per interview with the Biomedical Technician that same day, he stated “The machines leak between treatments. The bicarb is pressurized and if it isn’t bypassed, water and bicarb start coming out of the vent tube.” He further stated that the “machines are old” and “I am constantly working to maintain them.” It was acknowledged that these water spills created a slip/fall hazard for patients and staff alike by the Facility Administrator on 8/28/24.”

Pe - Equipment Maintenance - Manufacturer’S Dfu
The inspectors’ words, 207 words
“PE-EQUIPMENT MAINTENANCE-MANUFACTURER’S DFU CFR(s): 494.60(b) The dialysis facility must implement and maintain a program to ensure that all equipment (including emergency equipment, dialysis machines and equipment, and the water treatment system) are maintained and operated in accordance with the manufacturer’s recommendations. This Standard is not met as evidenced by: 28421 Based on tour of the patient treatment area and interview, it was determined that the dialysis machines in the facility were not maintained in a manner to provide a safe and functional environment to staff and patients. Findings were: “OSHA/Bloodborne Pathogen Regulations Policy #138-030-060” stated in part “The facility provides sufficient housekeeping and maintenance personnel to maintain the interior and exterior of the facility in a safe, clean, orderly, and attractive manner.” Tour of the patient treatment area on 8/28/24 revealed several areas (8X10 feet) of dried bicarbonate on the floor, surrounding patient chairs and dialysis machines. Photographs provided to the surveyor revealed pools of water on the patient treatment floor. The Facility Administrator acknowledged that the machines leaked but stated that the staff that opened the facility mopped the floor prior to the patients arriving. Both the Facility Administrator and the Biomedical Technician stated that the machines were “old and needed replacement” in interviews on 8/28/24.”
