What these words mean3
- Star ratings
- CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
- Inspection (survey)
- A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
- Deficiency, citation, violation
- What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Internal Grievance Process Components & Implemented
The inspectors’ words, 445 words
“GOV-INTERNAL GRIEVANCE SYS ID/IMPLEMENTED CFR(s): 494.180(e) The facility’s internal grievance process must be implemented so that the patient may file an oral or written grievance with the facility without reprisal or denial of services. The grievance process must include- (1) A clearly explained procedure for the submission of grievances. (2) Timeframes for reviewing the grievance. (3) A description of how the patient or the patient’s designated representative will be informed of steps taken to resolve the grievance. This Standard is not met as evidenced by: 36293 Based on policy review, record review and interview, the facility failed to implement their grievance policy. This deficient practice is evidenced by the facility not initiating the grievance process for 1 (#1) of 3 patient’s medical records reviewed. Findings: Review of the Dialysis facility’s Policy titled, “Customer Comments, Complaints and Grievances” revealed in part: A grievance is defined as a formal, written, or verbal complaint that is made to the facility by a patient, visitor, or support person (when the complaint is not resolved at the time of the complaint by staff present). Purpose: To provide a means to identify, investigate and determine resolution for all customer relation issues, including complaints, and grievances. Procedure: Any employee receiving a comment shall have the responsibility for entering the information into the on-line reporting system. A customer comment may come in the form of a phone call, written format (letter, email, fax, etc.) or personal visit. Staff investigating the complaint must identify that any response is provided to the next of kin or power of attorney. A written notice will be required when: Non-Medical staff grievances not resolved, or if the investigation is not or will not be completed within 7 days. Inform the patient in writing that the facility is still working to resolve the grievance and the facility will follow up with a written response within 30 days. A grievance is considered resolved when the patient is satisfied with the actions taken on their behalf. Review of Patient #1’s medical record revealed in part: 01/08/2024 S1MSW was contacted by Patient 1 this morning saying she was not coming to dialysis today with request to initiate immediate transfer to another dialysis clinic following an incident of uncontrolled bleeding on Friday 01/05/2024. Patient #1 also requested an administrator’s name and number for follow up and was provided the name and telephone number for the Director of Nursing at the hospital’s main campus. Interview on 03/11/2024 at 12:10 p.m., S2Safety Officer reviewed Patient #1’s medical record and the documented telephone call with S1 on 01/08/2024. S2 acknowledged this was a grievance and stated a grievance was never filed on behalf of Patient #1.”
